Özet

Bilindiği gibi, kamu idarelerinin mal veya hizmet alımları ile yapım işlerine ilişkin harcamalarda kamusal ihtiyaçlar göz önünde tutulmaktadır. Cari yıl içinde yapılacak harcamaların miktarları, bir önceki yılda kamu bütçelerine konulan ödeneklerle belli edildiğinden, tahsis edilen tutarlarda harcamalar yapılarak kamu hizmetlerinin devamlılığı sağlanır. Kamu alımları, ülkemizde yıllardır usulsüzlük ve yolsuzluk algısı ile bir arada anılır olduğundan ihale mevzuatı, Avrupa Birliği (AB) normları gözetilerek 2003 yılında yeniden düzenlenmiştir. Bu reform ile kamu alımları; ihale ve sözleşme yönetimi faaliyetleri olarak iki bölüme ayrılmakla birlikte, kurumsal ve kuralsal anlamda yeni bir yapı değişikliğine uğramıştır. Ancak, bu yapı kurgulanırken ihale senaryolarında rol alan aktörlere, uslu durmaları bakımından önleyici nitelikte çok yönlü yaptırım ve ceza sorumlulukları öngörülmüş olup, bu konuda son sekiz yıldır hiçbir şekilde geri adım atılmamıştır.

Abstract

As is known, public needs rather than the national income are taken into account in the public expenditures on the procurement of goods or services and the construction works. Since the amount of expenditures in the current year is stated as appropriations allocated for the public budgets in the previous year, expenditures are made in the amounts assigned to the public administrations regardless of the revenue that is obtained in that year, and thus the continuity of public services is ensured. Since public procurement, which is a significant part of these autonomous expenditures, has long been associated with the perception of irregularity and corruption in our country, the procurement legislation requiring expenditure was re-arranged in 2003 by considering the European Union (EU) norms. With this reform, public procurement was divided in two sections as tender and contract management activities, and a new structure was constructed in an institutional and normative sense. However, while this structure has been constructed, preventive multidimensional sanctions and penal responsibilities have been envisaged for the actors involved in the procurement scenarios; and in this respect, the government has not taken a step back in any way for the last eight years.
