Özet
Kişisel verilerin işlenmesinde genel ilkeler, 6698 sayılı Kişisel Verilerin Korunması Kanunu m. 4 hükmünde düzenlenmiştir. Bu hükme göre, kişisel verilerin işlenmesinde, hukuka ve dürüstlük kurallarına uygun olma, doğru ve gerektiğinde güncel olma, belirli, açık ve meşru amaçlar için işlenme, işlendikleri amaçla bağlantılı, sınırlı ve ölçülü olma, ilgili mevzuatta öngörülen veya işlendikleri amaç için gerekli olan süre kadar muhafaza edilme ilkelerine uyulması zorunludur. Bu ilkelerin her biri kişisel verilerin korunmasında eşit önemi haiz olup, birbirleri ile yakın bir bağ içindedirler. Bu ilkelerin bazıları, diğerleri üzerine kurulmak zorunda olan ilkelerdir. Kişisel verilerin işlenmesine ilişkin genel ilkelerin, kişisel verilerin korunması kapsamında bütün yasal düzenlemelere uygunluk açısından dikkate alınması gerekmektedir. Bu açıdan, genel ilkeler, veri koruma düzenlemelerine uygunluğun temelini oluşturmaktadır. Bu çalışmada, Kişisel Verilerin Korunması Kanunu’nun uygulanmasında yol gösterici olması açısından Avrupa Birliği düzenlemeleri de karşılaştırılmalı olarak ele alınmıştır.
Abstract
The general principles of data processing are regulated under Art. 4 of the Law on the Protection of Personal Data numbered 6698. . In accordance with this provision, in processing of personal data, it is mandatory to comply with these principles, which are lawfulness and conformity with rules of bona fides, accuracy and being up to date, where necessary, being processed for specific, explicit and legitimate purposes being relevant with, limited to and proportionate to the purposes for which they are processed, being retained for the period of time stipulated by relevant legislation or the purpose for which they are processed. Each of these general principles has equal importance and all are closely related to each other. Some of these principles are based on others. It is necessary to consider general provisions regarding processing of personal data in terms of compliance with all legislations within the context of personal data protection. In this sense, the general principles constitute the baseline of compliance to the data protection legislation. In this study, the European Union regulations have been examined from a comparative perspective in order to be a guide to practice of the Law on the Protection of Personal Data
