Özet
تناول البحث المسائل الفقهية التي فوض فيه الإمام الأعظم أبو حنيفة النعمان بن ثابت رحمه الله تعالى الحكم إلى رأي المبتلى الذي تعلق به الحكم الشرعي، حيث كان عادته ودأبه رحمه الله تعالى في المسائل التي تحتاج إلى تقدير، والتي لم يرد فيها نص، من كتاب أو سنة أو غيرهما؛ فإنه يفوض فيها الحكم الشرعية إلى رأي المبتلى.وعدد هذه المسائل بعد البحث والتفتيش اثنتا عشرة مسألة، خمس منها في أحكام الطهارة، وثلاث منها في أحكام الصلاة، وأربع منها في أحكام المعاملات والحدود.وذكرت في كل مسألة من هذه المسائل أقوال علماء المذهب الحنفي، مع ذكر الأدلة ومناقشتها إن وجد. وسلك الباحث في كتابة البحث المنهج العلمي الرصين الذي يعتمد على أخذ المادة العلمية من مصادرها الأصلية، وتخريج الآيات القرآنية بذكر اسم السورة ورقمها، والأحاديث النبوية الشريفة. وخاتمة، وفيها أهم النتائج الذي توصل إليها.
Abstract
The present research tackles issues that Imam Abu Hanifa Al-Numan , May Allah bless him , recommended prescript to the opinion of AlMubtallah as far as the religious rule was related .As usual , he was concerned with issues that were in need to estimation ,i.e. having no Quranic verses or Prophetic tradition (Hadith) .The number of these issues after scrutinizing was twelve , five of them related to purification , three related to prayers and four related to dealings and penalties . In each of these issues , sayings of the Hanafi School scholars had been mentioned besides mentioning evidence and their explanation where possible . The researcher follows a scientific approach in his research that depends heavily on the original references in addition to the Quran verses , their names and numbers as well as the prophet Mohammeds 'traditions and a conclusion having the important reached results.
