İlletin Tespitinde Münâsebet Metodu: Detaylı Bir İnceleme

Özet

Bu çalışma kıyasta şart olan illetin bilinmesini sağlayan; ihâle, istidlâl ve makâsıda riayet gibi farklı isimlerle isimlendirilen yolları açıklamaktadır. Bu, (hükümdeki) münasip illete ulaştıran aklî bir yöntemdir. Usûl alimlerine göre bunun netice verebilmesi için ya menfaat-mefsedet ya da ehl-i akıl kişilerin fiilerine göre olması gerekir. İlletteki münasebet, en fazla zannı gâlip ile tespit edilmesine rağmen kullanmak kaçışı olmayan bir durumdur. Onunla amel etmek hususundada güzel örnek sahabe-i kiramdır. Zira onlar gerçek hayatta uygulamışlar. Hüküm ile illet arasındaki münasebet üç kısımdır: Zarûrî, hâcî ve tahsînî. Zarûrî olan bütün semâvî şeraitler nezdinde “el-Mekâsıd’ül-Hamse el-Ulyâ” olarak bilinen maksadlardır. O da din, can, akıl, nesil ve malın korunmasıdır ki bunlar münasebet mertebelerinin en yücesidir. Münasebet bu denli önemli olduğundan, onunla illete üç yolla ulaşılabilir. Ya bir nas ile ya icma’ ile ya da istinbât ile ulaşılır. Bazen de illetin anlaşılması mümkün olmaz. Bununla birlikte hükme riayet illetin açığa çıkmasına bağlı değildir. Aksi takdirde yapılan kulluk mutlak teslimiyet üzerine kurulmuş hakiki kulluk olmaz.

Abstract

: This search has explained providing the know of hidden which is essential in syllogism; ways such as ihâle, deduction and obey makâsıd. This is a rational method of delivering proper hidden. According to the scholars of Usûl, for his to work, it must be either in accordance with interest-disorder or the acts of mind-bearer. Relationship at hidden, even though is most commonly determinated by the dominant guess, is a non-escaped situation. In terms of act with it, best example is Sahabe-i Kiram. Because they practiced this in real life. The relationship between judgment and hidden is three parts: indispensable (zarûrî), hâcî and tahsînî. Indispensable is purpose that it is known as al-Mekâsıd’ul-Hamse elUlyâ” in the presence of all divine conditions. These are: the protection of religion, life, reason, generation and property. Which are the highest of the relationship grades. Since the relationship is so important, can be reached it in three ways: with a religious texts (nass) or consensus (ijma) or derivation. And sometimes hidden can not be understood. Nonetheless obey the judgment doesn’t depend on come to light of hidden. Otherwise the servitude will not be genuine servitude established on a absolute devotion.
