Özet
Hukuk devletinin, genel anlamıyla, devletin hukuk yoluyla yönetimi olduğu söylenebilir. Bu nedenle de bu ilkenin gerçekleştirilebilmesi için kamu hukuku yargıcının üzerine düşen rol önemlidir. Toplumsal hayatın hızla değişen koşullarına, yasamanın her an veya sürekli olarak yanıt verebilmesi mümkün bulunmamaktadır. Bu nedenle zaman içerisinde ve uygulamada, hukuk kurallarının tekrar yorumlanmasına ihtiyaç duyulabilmektedir. Bu yüzden de idare ile birey arasında denge kuracak olan yargının, adalet idealini gerçekleştirebilmek için, hukuk kurallarını, anayasal değer taşıyan hukuk devleti ilkesi ışığında yorumlaması gerekmektedir. Diğer bir ifadeyle idari uyuşmazlıkların çözümünde idare yargıcı, hukuk devleti düşüncesini kararlarına yansıtmak suretiyle adalete yönelmek zorundadır. Bunu yaparken de idari yargıç, bir takım yöntem, teknik veya unsurlara başvurmalı ve kuvvetler ayrılığı sınırını aşmadan karar vermelidir.
Abstract
The rule of law, in general terms, can be said to be the management of the state by the law. Therefore, the role of the judge in public law is important for the realization of this principle. It is not possible for the legislature to respond continuously or at any time to the rapidly changing conditions of social life. Therefore, over time and in practice, it may be required to interpret law and regulations over again. For this reason, the judiciary, which would establish a balance between the administration and the individual, must interpret law and regulations in the light of the rule of law which is of constitutional value in order to achieve the ideal of justice. In other words, while solving administrative disputes, the administrative judge must turn to justice by reflecting the idea of the rule of law in decisions. For doing this, the administrative judge should decide by referring to certain methods, techniques or elements and without exceeding the limit of separation of powers.
