Özet
Hizmet tespiti davası açısından, taraflar arasındaki hukuki ilişkinin niteliği önem arz etmektedir. Hizmetlerin tespit edilebilmesi için tespiti istenen dönemdeki çalışmanın işçi olarak geçirilmesi gerekir. Adi ortaklık sözleşmesi, taraflar arasındaki hukuki ilişkinin ortaklık sözleşmesine değil, iş sözleşmesine dayandığının iddia edilmesi halinde hizmet tespiti davalarına konu olabilecektir. Zira mevzuattan doğan yükümlülüklerden kaçınmak amacıyla aradaki hukuki ilişkinin iş sözleşmesine değil, ortaklık sözleşmesine dayandığı ileri sürülebilmektedir. Bu noktada taraflar arasındaki hukuki ilişkinin niteliği ve bu niteliğin tespit edilebilmesi için dikkate alınabilecek ölçütler önemlidir. Çalışmamızda aradaki hukuki ilişkinin tespiti, adi ortaklık sözleşmesinin tanımı ve unsurları ile iş sözleşmesi ve unsurları karşılaştırma yapılmak suretiyle açıklanmıştır. Bu doğrultuda ilk olarak genel anlamda ortakların ve işçilerin sigortalılık statüsüne değinilmiş, hizmet tespit davası hakkında genel açıklamalarda bulunulmuş, akabinde ise aradaki hukuki ilişkinin tespitine ilişkin faydalanılabilecek ölçütlerden bahsedilmiş ve konuya ilişkin yargı kararlarına yer verilmiştir.
Abstract
In terms of the service detection case, the nature of the legal relationship between the parties is important. In order to determine the services, it is necessary to work in the working period to be determined as a worker. The ordinary partnership agreement may be subject to service detection cases the legal relationship between the parties to be based on a labor contract and not on the partnership agreement. Because, in order to avoid the obligations arising from the legislation, it can be argued that the legal relationship is not based on the employment contract but on the partnership agreement. At this point, the nature of the legal relationship between the parties and the criteria that can be taken into consideration for determining this attribute are important. In our study, the determination of the legal relationship between the parties, the definition and elements of the ordinary partnership contract and the elements of the employment contract and its elements are explained. In this context, firstly, the insurance status of the partners and workers were mentioned and general explanations were made about the service detection case and then the criteria that could be used for the determination of the legal relationship were mentioned and the judicial decisions were included in the subject.
