Özet

Bir yargı yerine erişim güvencesi, adil yargılanma hakkının ön şartıdır. Mahkemeye erişim mutlak ve sınırsız değildir. Devletler tarafından değişen şartlara ve gereksinimlere göre, hakkın özüne zarar vermeyecek biçimde kısıtlamalar getirilebilir. Yasa koyucu tarafından getirilecek olan sınırlamalara ilişkin mevzuatı yorumlama görevi ilk derece mahkemelerine ve yüksek yargı mercilerine düşmektedir. Bu mahkemeler mevzuatı ve özellikle usul kurallarını somut olaya uygularken ne abartılı bir esneklikten yana olmalı ne de aşırı şekilci davranarak işin özünü kaçırmalıdır. Mahkemeye erişim hakkı zedelenmemelidir. İdari yargının görevli olmasına rağmen, yanılgıya düşerek görevsiz yargı yerinde (adli veya askeri) açılan davalar üzerine, İdari Yargılama Usulü Yasasının 9.maddesi uygulama alanı bulacaktır. Görevsiz yargı yerinin, mevzuatta olmayan bir biçimde görevsizlik kararı sonrası dava dosyasını idari mahkemeye göndermesi ve yanlış olan bu uygulamanın ortaya çıkarttığı birtakım sorunlar gündeme gelmektedir. İdari mahkemelerin geliştirdiği içtihatlarla bu sorunlara getirdiği çözüm önerileri olduğu gibi, bu konuda katı idari yargı uygulamaları da vardır. Avrupa İnsan Hakları Mahkemesinin, usul kurallarının çok katı bir biçimde uygulanması nedeniyle, davacıların mahkemeye erişim haklarından yoksun bırakıldığından bahisle ihlal kararı verdiği Mesutoğlu/Türkiye kararı, idari yargıçlar için yol gösterici niteliktedir.

Abstract

Access to a court is a precondition of the right to a fair trial. However, access to a court is not absolute and without limits. States may introduce restrictions on this rightdepending on changing circumstances and needs; but these restrictions should not damage the spirit of this right. It is the duty of the first instance and high courts to interpret the legislation on such restrictions. When applying the legislation and especially the rules of procedure to specific matters, the courts should avoid excessive flexibility and also the risk of missing the substance by emphasizing the formal aspects too much. The right to access a court should not be injured. Article 9 of the Code of Administrative Procedure is applicable to cases filed by mistake before civil or military courts which lack competence rather than the competent administrative courts. After rendering a decision of incompetence, the respective court refers the case file to an administrative court, which has no legal basis and leads to various issues in practice. In addition to the administrative case-law, one also finds strict practices by the administrative judiciary. The judgment of the European Court of Human Rights in Mesutoğlu v. Turkey where the Court held that the applicants were deprived of the right to access to a court as the procedural rules were applied very strictly will provide guidance to administrative judges.
