Türkiye’de telekomünikasyon yoluyla yapılan iletişimin önleme amaçlı denetlenmesi

Özet

Ülkemizde ve dünyada suç ve suçluyla mücadelede çok çeşitli yöntemler geliştirilmiş ve geliştirilmektedir. Söz konusu yöntemlerin bazıları suç işlenmeden önceki döneme ilişkin iken bir kısmı ise suç işlendikten sonrasıyla ilgilidir. İletişimin denetlenmesi tedbiri de bu yöntemlerdendir ve suçun işlenmesinden önceki döneme yönelikse iletişimin önleme amaçlı denetlenmesi, suç işlendikten sonra soruşturma ve kovuşturma aşamasında uygulanıyorsa iletişimin adli amaçlı denetlenmesi tedbiri ortaya çıkmaktadır. İletişimin adli amaçlı denetlenmesi tedbirine 5271 sayılı Ceza Muhakemesi Kanunu’nda yer verilmişken, iletişimin önleme amaçlı denetlenmesi tedbiri 2005 yılında kabul edilen 5397 sayılı Kanun’la düzenlenmiştir. Bu kanunda; Polis, Jandarma ve Milli İstihbarat Teşkilatı iletişimin önleme amaçlı denetlemesini yapmaya yetkili kurumlar olarak belirlenmiş olup, tedbirin kural olarak hâkim kararıyla gerçekleştirilebileceği ancak, gecikmesinde sakınca bulunan hallerde, 24 saat içinde yetkili ve görevli hâkim onayına sunulmak şartıyla, ilgili kurumların kanunda belirtilen mercilerin yazılı emriyle de bu tedbirin uygulanmaya başlayacağı belirtilmiştir. İlgili kurumlar söz konusu denetlemeyi Telekomünikasyon İletişim Başkanlığı (TİB) aracılığıyla yerine getireceklerdir. TİB bu tedbiri uygulamaya başlamadan önce söz konusu tedbirin gerekli şartları taşıyıp taşımadığını kontrol edecektir. Bu şartların bir arada bulunmaması durumunda, kararı veya emri yerine getirmeyerek ve eksiklerin giderilmesi maksadıyla ilgili makamlara iade edecektir. İletişimin önleme amaçlı denetlenmesi neticesinde elde edilen bilgilerin maksat dışı kullanılmasının önlenmesi için, tedbir sonlandırıldığında, elde edilen kayıt ve bilgiler, tedbir talebinde bulunan ilgili kurumların en üst amirinin ve bu kayıtların Telekomünikasyon İletişim Başkanlığı’nda tutulması halinde Başkanın denetimi altında en geç 10 gün içinde yok edilecektir. Yok edilecek bilgiler, elde edilen ancak muhtevaları itibarıyla kullanılmasına gerek duyulmayan bilgilerdir. İletişimin denetlenmesine dair işlem ve kararlar ile tedbirin uygulanması sonucu elde edilen kayıtlar, hem haberleşme özgürlüğü ve özel hayatın korunması hem de soruşturmanın gizliliği kuralı gereği, tedbir süresince ve tedbir süresinin bitiminden sonra gizli tutulacaktır.

Abstract

Quite various methods have been and will be developed for fight against crimes and criminals in our country and in the world. Some of these methods relate to the period before a crime is perpetrated and the others concern the period after the crime. Inspection of the communication is also one of these methods. It is considered to be preventive in cases where it is intended for pre-crime period and if it is performed in the post-crime period or during the investigations and proceedings, it is considered to be inspection of the communication for judicial purposes. While the inspection of the communication for judicial purposes is mentioned in the Code No. 5271 of Criminal Procedure, inspection of the communication for preventive purposes is governed by Law No. 5397 adopted in 2005. In this Law Police, Gendarmerie and National Intelligence Organisation have been stated as bodies authorised to carry out the inspection of communication for preventive purposes. It is also clearly stated in the Law that this measure may be taken, as a rule, upon a verdict by the judge; however, in cases where any delays in the performance of this measure are likely to cause harm, this measure may be taken upon the written mandate by the authorities laid down in the Law of the relevant bodies provided that it is submitted to the approval of competent and authorised judge within 24 hours. Relevant bodies shall carry out the inspection in question through Telecommunications Communication Presidency (TIB). Before implementing this measure, TIB shall check whether the measure in question meets the necessary conditions. In cases where the measure does not satisfy the necessary conditions, TIB shall not implement the decision or the mandate and shall return it to the relevant authorities for the completion of deficiencies. In order to prevent the misuse of information obtained as the result of inspection of communication for preventive purposes, all records and information obtained shall be exterminated within 10 days under the supervision of the top manager of the relevant body requesting the measure in question once the measure is completed and if these records are retained within the body of Presidency of Telecommunications Communication, the President should also attend to the extermination of the records. Information which is to be destroyed is information which is obtained, but not necessary for use by reason of its content. All records and information obtained during the measure process and after the completion of the implementation of the measure shall be kept confidential as required by procedures and decisions regarding the inspection of the communication and byboth communication freedom and protection of privacy and the rule of confidentiality of the investigation.
