Özet
Günümüzde hukuk alanında, anayasa ve hukuk sistemi tartışmalarının bir hayligölgesinde kalmış lakin en az onun kadar önemli bir nokta da hukuk eğitimidir. Çünküne kadar mükemmel bir anayasa yapılırsa yapılsın sonuçta ortaya çıkacak anayasalkurumların birçoğu hukukçular eliyle yürütülecektir. Aynı şekilde ne kadar üst düzeybir hukuk sistemi kurulursa kurulsun yine bu sistemin işlemesi ülkedeki hukukçularabağlıdır. Yani iyi yetişmemiş hukukçuların elindeki bir anayasanın ve hukuk sistemininçok da bir önemi olmayacaktır. Bu gerçekten yola çıkarak en az sistemlerin oluşturulmasına olduğu kadar sistemiişletecek bireylerin eğitimi konusuna da eğilmek gerekir. Bu sebeple, bu makaledeülkemiz hukuk eğitimi sisteminin bazı reformlara ihtiyaç duyduğu konusu üzerindedurulmuştur. Bu çerçevede mevcut hukuk eğitim sistemi değerlendirilmiş ve var olaneksiklikler saptanmıştır. Ardından özellikle Bologna Süreci göz önünde bulundurularakdünyadaki modern eğitim sistemleri irdelenmiştir. Son olarak da rol model olabilecekeğitim sistemleri ışığında hukuk eğitim sistemimiz için çeşitli çözüm önerileri sunul- muş ve açıklanmaya çalışılmıştır.
Abstract
Although it has been overshadowed by discussion of the elaboration of currentlegal system (in Turkey) and the issuing of a new constitution, law education is as im- portant as previews two. It is well know that no matter how flawless a constitution (orthe legal of system of a country) may be, it will put into force by jurists. Therefore, theeffectiveness of a legal system depends on lawyers and judges who may fail to enforce insufficient due to their ineffective law education. For this reason, training of lawyersis as important as the issuing of a constitution. Hence, this article aims to present the reasons an urgent reform in law education.First, the current system about legal education that has been discussing the existingproblems was determined. Then the systems of some countries particularly with con- sideration of Bologna Process were examined. Finally, in the lights of modern educa- tion systems some solution proposals were suggested.
