Özet
İslam hukukunda velayet önemli bir yer tutmaktadır. Velayetin mahal ile ilgili olarak mali velâyet ve nefsi velâyet, özel ve genel sıfatla ilgili olarak velâyet-i âmme ve velâyet-i hâssa, yetki tasarrufu bağlamında velâyet-i icbâr ve velâyeti ihtiyari olmak üzere birçok açıdan taksimi yapılmıştır. Velayet meselesindeki sıralama cumhura göre miras sıralamasıyla aynıdır. Bütün mezheplere göre velinin velâyet yetkisini kullanması için bazı şartlara haiz olması gerekir. Bütün mezheplerin üzerinde ittifak ettiği şartlar; akıl, bulûğ, hürriyet ve din birliği şartlarıdır. İttifak edilen şartlar dışında üzerinde ittifak edilmemiş bazı şartlar da vardır. Veli için zikredilen şartlardan biri bulunmadığı takdirde velinin velayet yetkisi ya sınırlandırılır ya da ortadan kalkar. Bu durumda velâyet hakkı ya şer'î hâkime veya daha uzak bir veliye verilir
Abstract
Custody occupies a major position in the Islamic law. Custody is classified dually in many aspects such as financial custody and self custody according to location; general custody and special custody according to special and general specification; forced custody and selective custody according to authority disposal. The ranking in custody is as per the inheritance ranking according to the majority. The custodian should be holding certain features in order to use the custody authority according to all sects. All sects have compromised on the conditions of wisdom, puberty, freedom and religious unity. However they have not agreed on some other conditions. In case one of these conditions specified as features of custodian does not exist, the custody authority of the custodian is either restricted or abolished. In this case the custody is transferred to the ruler (a sultan) or another custodian located in a further distance.Key Concepts: Custody, near, far, custodian
