Özet

Levinas adalet kavramını öncelikle ayrımcılığın, ayrıcalıxğın ortadan kaldırılması, eşitlik, adilbir yasanın adaleti, yasallık vb. anlamında kullanır. İkinci olarak adalet ilk anlamı aşan etik birtalebi dile getirir. Daha çok üçüncü şahısla ilişkiyi belirlemek için kullanıldığı halde, Levinas'ınbaşkası ile ilişkiyi de adalet olarak adlandırmaktan kaçınmadığı anlar vardır. Üçüncü ile ilişki bizisiyasete, devlete, yasallığa, bir vatandaşlar düzenine götürür. Başkası ise bu düzeni kesintiyeuğratandır. Başkasıyla karşılaşma anlamındaki adalet, aynı zamanda devletin sınırıdır. Levinas,başkasıyla ilişkinin üçüncü şahısla ilişkiden ayrılamayacağını burada da vurgular. Ama b aşkasınınyüzünden doğan adaleti, daha çok başkasına karşı sınırsız sorumluluğumuza bir sınır koyan üçüncüşahıs ile ilişki anlamında ele alır.Birinin sorumlu olduğu kişi eşsizdir ve sorumlu olan kişi bu sorumluluğunu devredemez. Buanlamda, sorumlu olan kişi de eşsizdir. Bu noktada Levinas karşılıklılığın söz konusu olmadığı birilişkiden, bir toplumun üyeleri arasında eşitlik ve karşılıklılığın varolduğu bir ilişkiye geçer. Onunadalet arayışı, böyle yeni bir ilişkiyi varsayar. Adalet, her ne kadar adal eti kurumsallaştırsa vesürdürse de devletten değil, başka insanların, dulun yetimin, yabancının aşkınlığından türer. Levinas için adaletin gerçek doğası, öznellik kendini sorumluluk olarak anladığı zaman ortayaçıkar, çünkü sadece bu durumda adaletin tümel olanı aştığını, adaletin olduğu şey haline gelmesi için,kanunların tümelliği olabildiğince temsil ettiği kadar, yazılı kanunların ötesine geçmesi gerektiğianlaşılabilir.

Abstract

Levinas employs the term justice primarily as elimination of discrimination and privilege. Heuses the term as equality, justice of a fair law system. Secondarily he express es an ethical claim fort heterm justice. Although justice is used for determining the relationship with the third person, Levinasdoes not hesitate to name the realtionship with the other as justice . The relationship with the ThirdParty relates us to politics, state, legality and a civic order. The Other, on the other hand, leads thisorder to interruption and discontinuity. The meaning of justice in the encounter with the Other is alsothe limit of the State. Here Levinas emphasizes that the realti onship with the Other cannot bedifferentiated from the relationship with the third party. Rather, he discusses that the justice whichcomes from the relationship with the Other puts a limit to our limitless responsibility for the thirdparty.The person whom one is responsible for is unique and the responsible person cannot hand overhis responsibity. Thus, the responsible person is also unique. In this context, Levinas passes from arelationship which lacks counterpartness to a relationship where equalit y and counterpartness existamongst the members of a society. His search for justice assumes such a novel relationship. No matterhow much justice is institutionalized and continued by the state, it stems from the other people stranscendantal thoughts about widowed, orphan and the foreign . For Levinas, the genuine nature of justice appears when subjectivity conceives itself as theresponsibility. Because only in this situation can the justice transcends the whole, and become thething that is justice itself. Hence as much as the laws representing the whole, justice can extendbeyond the written laws.
