Özet
Tüm hukuk sistemleri fertler arasında can ve mal güvenliğini korumak ister. Osmanlı hukukunda da, toplumda huzursuzluğa yol açanlar, can ve mal güvenliğini tehlikeye atanlar hakkında ağır yaptırımlar uygulanmıştır. Hırsızlık suçu da bunlardan biridir. Bu suçu işleyenler hakkında verilmiş olan cezanın altında yatan asıl gaye, toplum düzenini korumak, sosyal yapının bozulmasına engel olmak ve fertlerin mal güvenliğini sağlamaktır. Bu çalışmanın amacı, Bursa Şer’iyye Sicillerinden 16.-18. yüzyıllara ait hırsızlıkla ilgili dava örneklerinden sondaj yöntemiyle bulunan kayıtlardan yola çıkarak Osmanlı Ceza Hukuku’nun hırsızlık suçuna ilişkin uygulamasını ortaya koymaya çalışmaktır. Temel kaynak olarak Bursa Şer’iyye Sicilleri, Kâmil Kepecioğlu’nun Bursa Kütüğü adlı 4 ciltlik eseri ile yayınlanmış mühimme defterlerinden faydalanılmıştır.
Abstract
All legal systems aim at maintaining peace, security and order among individuals. In Ottoman legal system, too, those crimes which were threatining the security of life and of property were heavily condemned extreme sanctions were applied against them. The crime of theft was one of such heavy crimes. The underlying reason for the adoption of grave punishments imposed on those who committed this crime was to maintain the social order, to prevent deganeration of the social structure and to secure the properties of individuals. In this study, the fundamental approaches, treatments and applications in the Ottoman Criminal Law concerning the crime of theft are explored with reference to the cases hit on in the Bursa Shari’a Court Records during our long-term thematic survey of historical documents between 16th and 18th centuries. Besides the court documents, the four-volume Bursa Kütüğü (Bursa Register) by Kamil Kepecioğlu and the Mühimme Defterleri (Imperial Notebooks of Importance) published so far are used as primary sources.
