Özet

İşçinin iş sözleşmesinden doğan asli borcu iş görme borcudur. işçi bu borcunu yerine getirirken birtakım yan yükümlülüklere de uymak zorundadır. işçinin sadakat borcu da iş sözleşmesinden doğan temel yükümlülüklerinden birisidir. işçi, sadakat borcu gereği birtakım eylemleri yapmak, birtakım eylemleri de yapmamak zorundadır. Rekabet etmeme borcu iĢçinin sadakat borcunun olumsuz yanını oluşturmaktadır. işiçinin rekabet etmeme yükümlülüğü iş sözleşmesi devam ederken dürüstlük kuralı gereği mevcuttur. Diğer bir ifade ile iş sözleşmesi devam ederken rekabet etmeme borcundan söz edebilmemiz için, tarafların ayrıca rekabet yasağına ilişkin bir düzenleme yapmalarına gerek bulunmamaktadır. iş sözleşmesinde tarafların karşılıklı birbirine güveni çok önemli bir unsur olduğu için rekabet yasağı iş sözleşmesinin içinde kendiliğinden mevcut olur. Bu borç iş Kanunumuzda açıkça düzenlenmemiş olmasına karşın iş K.m.25/II-e de sayılan ahlak ve iyi niyet kuralına uymayan haller kapsamında değerlendirilir ve işçinin bu yükümlülüğü ihlal etmesi, işverene sözleşmeyi haklı sebeple fesih hakkı verir.

Abstract

The employee’s principal debt arising from employment agreement is service obligation. It is mandatory for the employee to fulfill a number of additional obligations while performing above mentioned duty. The employee’s duty of loyalty is also one of the basic contractual obligations in accordance with the employment agreement. The duty of loyalty includes an employee’s duty not to act in some instances or act in other instances. The duty of non competition characterizes the negative aspect of the duty of loyalty. The employee’s duty of non competition during the period of a contract of employment arises from good faith. In another words, throughout the duration of the employment contract, parties do not need to make further regulation with respect to the non competi-tion. Since the mutual trust is a fundamental element for the employment con-tract, the provision of non competition involves in this contract spontaneously.Although the obligation of non competition is not regulated in Labour Law, it is evaluated within the scope of situations contrary to the moral rules and good faith referred to in Article 25/2 of this law. Furthermore the violation of this duty gives the employer the right to terminate the agreement for cause.
