Özet

Uluslararası ticarî ilişkileri geliştirmeyi amaçlayan sözleşmelerden en önemlilerinden biri 10 Haziran 1958 tarihli Yabancı Hakem Kararlarının Tanınması ve Tenfizine İlişkin New York Sözleşmesi’dir. Bugün için 149 devletin taraf olduğu sözleşme, uluslararası ticarî ilişkilerden kaynaklanabilecek muhtemel uyuşmazlıkların tahkim yoluyla çözümlenmesi hâlinde, elde edilen hakem kararının diğer devletlerde de icra edilebilmesine imkân tanımaktadır. Sözleşme, tenfiz talebinin reddini gerektiren sebepleri iki ana başlık altında toplamış ve bu sebeplerin bir kısmının iddia eden tarafça iddia ve ispatını şart koşmuştur. Hakem kararının, tenfiz talep edilen devletin kamu düzenine aykırı olması hâlinin de yer aldığı ikinci kategorideki sebepler ise, ilgili devlet mahkemesince kendiliğinden dikkate alınacak tenfiz engelleridir. Bu kapsamda, hakem kararının gerekçesinin yeri ve önemini tespit etmek gerekmektedir. Diğer bir deyişle,hakem kararının gerekçe kısmına yer vermemesinin tenfiz engeli olarak kabul edilip edilemeyeceği incelenmelidir. Bu noktada, birçok konuda tarafların iradesine öncelik tanıyan tahkim yargılamasında, kararın gerekçesiz olması noktasında da tarafların ortaya koydukları iradenin geçerli kabul edilip edilemeyeceği de dikkate alınmalıdır. Çalışmamızda, tüm bu noktalar ele alınarak, uluslararası düzenlemeler ve Türk hukukuna hâkim olan kurallar çerçevesinde, gerekçesiz bir hakem kararının New York Sözleşmesi’ne göre tenfiz edilip edilemeyeceği sorusuna bir cevap aranacaktır.

Abstract

One of the most important conventions, which aims to develop international commercial relations, is the Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 10 June 1958.Now 149 states became parties to theConvention, which makes it possible to enforce an arbitral award in the territory of other states. The Convention groups the reasons that require refusing the recognition and enforcement of an arbitral award under two basic sub-titles. Some of the reasons have to be furnished and proved by the party against whom the award is invoked. The other group of reasons, involves the reason that award would be contrary to the public policy of the country where recognition and enforcement is sought, shall be taken into consideration by the competent authority. Here, the place and the importance of the grounds that the award relied upon must be dealt with. In other words, it must be studied that whether an award includes its grounds requires refusing the recognition and enforcement of it or not. It must also be considered that whether the parties can also agree on that the award shall not contain its grounds, while they are making an agreement for the arbitration proceeding, which gives opportunity to the parties to agree on lots of related points of the proceeding. In the light of international regulations and the fundamental principles of Turkish law, this article aims to find a solution for the problem that whether an award lacking of grounds can be enforced according to New York Convention.
