Kıymetli evrakın ziyaı nedeniyle iptalinde ve önleyici tedbir yargılamasında görevli mahkeme sorunu

Özet
Mahkemelerin görevi kanunla düzenlenmiş olup, görev kuralları, kamu düzenine ilişkindir ve taraflar ileri sürmese de temyiz dâhil, yargılamanın her aşamasında re’sen nazara alınacak dava şartı niteliğindedir. Kıymetli evrakın ziyaı nedeniyle iptalinde, 6102 sayılı Yeni Türk Ticaret Kanununda özel bir düzenleme bulunmadığından, Yeni TTK’nın 4, 5 ve 757’nci maddeleri ile HMK’nın 2, 382 ve 383’üncü maddelerinden yararlanılarak, görevli mahkemenin tespit edilmesi gerekir. Fakat bu konuda, Yargıtay 11. HD’nin ve Yargıtay 17. HD’nin birbirinden farklı kararları olduğunu belirtmekte yarar vardır. İlk derece mahkemelerinden asliye hukuk ve sulh hukuk mahkemelerinin kıymetli evrakın ziyaı nedeniyle iptaline ilişkin vermiş oldukları ve kesinleşen görevsizlik kararları merci tayini için Yargıtay 17. HD’ye, ilk derece mahkemelerinden asliye hukuk ve sulh hukuk mahkemelerinin kıymetli evrakın ziyaı nedeniyle iptaline ilişkin vermiş oldukları görevsizlik kararlarının temyiz edilenleri ise, Yargıtay 11. HD’ye gitmektedir. Yargıtay 17. HD ile Yargıtay 11. HD’nin kıymetli evrakın ziyaı nedeniyle iptaline ilişkin açılan davalarda görevli mahkemenin belirlenmesine ilişkin vermiş oldukları farklı kararlar arasındaki çelişkinin giderilebilmesi için, bu sorun bir an önce Yargıtay Hukuk Genel Kuruluna getirilmelidir.
Abstract
The jurisdiction of courts are established by the law and the rules of jurisdiction pertain to the public order and constitute the prerequisite of a case which are to be considered proprio motu at every stage of the proceedings including the appellate proceedings even if the parties do not file an application. Now that the issue of annulment of lost negotiable instruments is not provided in the new Turkish Commercial Code (TCC) No: 6102, the competent court needs to be designated by using Articles 4, 5 and 757 of the new TCC and Articles 2, 382 and 383 of the Code of Civil Procedure. It should be noted, however, that the 11th and 17th Civil Chambers of the Court of Cassation have rendered differing judgments on this matter. The finalized decisions of non-jurisdiction by the civil courts of first instance and civil courts of peace in respect of the annulment of lost negotiable instruments are referred to the 17th Civil Chamber of the Court of Cassation and the appealed of non-jurisdiction by the civil courts of first instance and civil courts of peace in respect of the annulment of lost negotiable instruments are referred to the 11th Civil Chamber of the Court of Cassation for the designation of the competent body. The differing judgments of the 17th and 11th Civil Chambers of the Court of Cassation on the designation of the competent court in cases of annulment of lost negotiable instruments needs to be addressed by the General Board of Civil Chambers of the Court of Cassation.
