Özet
Ceza yargılamasında mağdurun bir suje olarak kabul edilişi çok yenidir. Geçmişten günümüze var olan devlet anlayışı, her türlü suç bakımından asıl mağdurun kendisi olduğu şeklindedir. Ne var ki bu anlayış mağduru yargılama sürecinde bir kenara itmiş; adeta unutulmuş insan konumuna getirmiştir. Mağdurun bu durumu karşısında daha fazla sessiz kalamayan modern hukuk, ceza yargılamasında faile tanıdığı hakların yanı sıra mağdura da bir takım haklar tanımıştır. Böylelikle mağdur -tekrar ilkel dönemlerdeki gibi- uyuşmazlıkların çözümünde söz sahibi olmaya başlamıştır. Pek tabi Türkiye de bu gelişmelere duyarsız kalmamıştır. Bu bağlamda mağdura bir takım haklar tanıyarak onu ceza yargılamasında suje konumuna getirmiştir. Mağdur hakları, en açık ifade ile 5271 sayılı yasanın 234. maddesinde düzenlenmiştir. Yine ceza mevzuatının diğer düzenlemelerinden çıkan mağdura tanınmış bir kısım haklar bulunmaktadır. Bununla birlikte gerek uygulama, gerekse bazı hususlardaki yasal düzenlemelerin yetersizliği nedeniyle mağdur haklarının etkin şekilde kullanıldığı söylenilemez. Bu çalışmamızda Türk Ceza yargısı sürecinde mağdura tanınan hakların ne olduğunu anlatacağız. Bu bağlamda hakların önemini, olması gerekenin ne olduğunu yeri geldikçe irdeleyeceğiz.
Abstract
It is recent in criminal procedure that an victim's of crime is accepted as a subject. According to existing state concept from past to present, the victim's of crime is itself in every criminal aspect. However this understanding pushed the victim's of crime aside, almost set him/her as a forgotten person.Modern law which could not kept its silence in that position of the victim's of crime anymore, accorded rights for the victim as well as it did for the perpetrator. Thus the victim – like in primitive era again – had a voice in the settlements of conflicts. Turkey also did not remain intensive to this progress. In this context, Turkey accorded some rights for the victim's of crime, and set it as a subject in criminal procedure. The rights of the victim overtly regulated in the law number 5271, clause 234. Also certain rights are accorded to the victim in the other regulations of penal legislation. On the other hand it cannot be said that the victim rights are efficiently used due to both practice and the legal arrangements in some matters. In this study, we are going to explain the accorded rights for victim's of crime the course of Turkish Criminal Jurisdiction. In this regard we are going to examine the importance of rights and what should be, as the occasion arises.
