Özet

6458 sayılı Yabancılar ve Uluslararası Koruma Kanunu’nun, idari yapıya ilişkin hükümleri 11 Nisan 2013, diğer hükümleri ise 11 Nisan 2014 tarihinde yürürlüğe girmiştir. Yabancılar ve Uluslararası Koruma Kanunu, Avrupa Birliği göç ve iltica mevzuatı esas alınarak hazırlanmıştır. Bununla beraber YUKK’un hazırlık sürecin- de diğer ülkelerin göç ve ilticaya ilişkin mevzuatı ile uygulamaları ve idari yapıları da incelenmiştir. YUKK’un hazırlık çalışmaları sürecine etki eden birçok faktör ol- masına rağmen AİHM kararları, bu faktörler içinde belki de en önemli yere sahiptir. Bu öneminden dolayı çalışmamızda, 11 Nisan 2013 tarihinden önce sığınma ve iltica talepleri reddedilen ve Türkiye’den sınırdışı işlemleri başlatılan yabancılar tarafından AİHM’de açılan davalarda verilen kararların YUKK üzerindeki etkisi incelenecektir.

Abstract

The provisions of the Law on Foreigners and International Protection, Law No. 6458, concerning migration management have come into force on 11 April 2013, and the other provisions have been in force since 11 April 2014. The Law on Foreigners and International Protection was basically drafted in accordance with the European Union migration and asylum law. However, the migration and asylum laws in vari- ous countries as well as their practices and their authorities responsible for migrati- on and asylum were also considered in the preparatory stage of the Law. Although many factors influence the drafting process of the Law on Foreigners and International Protection, the judgments of the European Court of Human Rights perhaps have the most significant impacts. Having considered significant impacts of those judgments, this article is devoted to analyse the effects of the judgments of the European Court of Human Rights on the Law on Foreigners and International Protection concerning the foreigners whose refugee or asylum seekers applications were refused and about whom expulsion process were initiated before 11 April 2013.
