Özet
Töre, hukuki ve sosyolojik boyutları olan kültürel bir kavramdır. Bir hukuk sisteminin töre gibi toplumsal karşılığı olan sosyolojik normlara ve dolayısıyla kültüre yaklaşımı ile onu ele alış biçimi, hukukun idesi olan adaletin toplum vicdanında yer edinmesiyle yakından ilgilidir. Temelde tepeden inmeci ve dönüştürücü şartlanmaların hâkim olduğu hukuk sistemlerinde kültürel normlar dışlanmakta ve hukuk sistemi içerisinde evrilmelerine imkân tanınmamaktadır. Dışlanan her sosyolojik yapı doğal olarak koruma güdüsüyle içine kapanmakta ve zamanla yozlaşmaktadır. Türk Hukuk Sisteminin kültür kavramı çerçevesinde töreye ve töre saikiyle işlenen cinayetlere yaklaşımı irdelenmesi gereken bir mahiyeti havidir. Zira hukuk sistemimizin bu konudaki tutumunun kanuni olduğu yadsınamaz bir gerçeklik olmakla birlikte ne kadar hukuki olduğu tartışmaya açıktır. Burada amaç, töre sebebiyle işlenen cinayetleri meşru göstermek değildir. Ancak belirtelim ki, töreyi bir bütün olarak ilkel ve çağdışı görmek çözüm olmadığı gibi toplumda var olan algıları bir başka kültürün ifadesi olan hukuk eliyle ve zorla değiştirmeye çalışmak da sosyolojik dilemma ve travmalara sebep olabilmektedir.
Abstract
Custom, which has legal and sociological aspects, is a cultural concept. The approach and the method of approaching of a legal system towards sociological norms that have social value, such as custom and hence culture, is closely related with acquisition of justice which is the purpose of law, in the public conscience. In law systems in which basically top-down and converter conditionings are dominant, cultural norms are excluded and are not permitted to evolve within the legal system. Inherently, of each excluded sociological structure withdraws motivated by the protection of itself and degenerates in course of time. The Turkish Legal System s approach to the custom and honor killings within the framework of the concept of culture has a nature that should be analyzed. Because it is an undeniable fact that our legal system s attitude on this issue is statutory but it is open to debate how/to what extent legal it is. The goal here is not justify the honor killings. However it should be noted that, as it is not the right solution to see the custom primitive and outworn/outdated as a whole; trying to change perceptions that exist in society by force and through the law which is an expression of another culture also may lead to sociological dilemmas and traumas.
