Gümrüklerde fikri mülkiyet hakkının korunması

Özet
Fikri mülkiyet haklarının gümrük noktarında korunmasına ilişkin mevzuat, AB’nin 608/2013 Sayılı 12.06.2013 tarihli Gümrüklerde Fikri Mülkiyet Hak‐ larının Korunması Hakkındaki Parlamento ve Konsey Tüzüğü ile uyumlu bi‐ çimde düzenlenmiş ve uygulanmaktadır. Marka sahiplerinin tekelci hakları, MarkKHK’nın 9. maddesinde düzenlen‐ miş olup, aralarında “başkalarının markayı taşıyan malları gümrük bölgesine sokması, gümrükçe onaylanmış bir işleme tabi tutması” na engel olma hakkı da bulunmaktadır. MarkKHK’nın, markaya tecavüzü düzenleyen 61. maddesinin 9. maddeye yollaması nedeniyle, bu eylem tecavüz olarak kabul edilmektedir. Korsan veya taklit eşya tabirlerinin tanımları, imha süreci ve imha şartları da gerek AB Tüzüğü ve gerekse TRIPS Anlaşması hükümleri ile uyumlu bulun‐ maktadır. Fikri mülkiyet haklarının, ülkesel karakteri bozulmadan, ihlallerin gümrüklerde önlenmesi, ulusal ve uluslar arası düzeyde korumanın gereğidir. Öte yandan bu tür malların gümrük noktalarında ayıklanması, pazara so‐ kulmaması önem arz etmektedir ve bu yön Gümrük Kanunu ile Yönetmelikçe düzenlenmiştir. Bu yazıda, başta marka ihlalleri olmak üzere, fikri mülkiyet haklarının sınır aşan karakterleri nedeniyle gümrük kapılarında uygulanması ve korunması konusu ele alınmaktadır.
Abstract
The legislation that pertain to customs enforcement of intellectual property rights has been enacted and is being implemented in compliance with the Re‐ gulation (EU) No 608/2013 of the European Parliament and of the Council of 12 June 2013 Concerning Customs Enforcement of Intellectual Property Rights. Exclusive rights of trademark owners are provided in Article 9 of the Le‐ gislative Decree on Trademarks, which also include the right to bar “entry of the goods that bear others’ trademark into a customs territory, and subjection to a customs approved procedure”. Such action is, according to the reference in Article 61 on infringement to Article 9, deemed as an infringement. Defini‐ tions of pirated or imitated goods, the destruction process and the conditions for destruction are in compliance with provisions of both the EU Regulation and the TRIPS Agreement. Prevention of any intellectual property right infrin‐ gement at the customs, without having its territorial characteristics spoiled, is needed for protection both at national and international levels. On the other hand, sorting out of these kinds of goods at customs checkpo‐ ints, disallowing their entry into the market is of significance and; this aspect is being regulated by the Regulation as provided in the Customs Law. In this article, enforcement and protection of intellectual property rights at customs – first and foremost in the case of trademark infringements – because of their cross-border characteristics is discussed.
