Özet
Özet Avrupa Birliği Adalet Divanının (ABAD) yeni Yargılama Usul Kuralları 1 Kasım 2012 tarihinde yürürlüğe girmiştir. Bu reformlar, yargılama sürecinin dava tarafları ile üye ülke ulusal mahkemeleri için daha basit ve daha açık hale getirilmesi amacıyla kabul edilmiştir. Ayrıca, bu reformlar, Yargılama Usul Kurallarının yapısı ve içeriğini ABADın mevcut iş yükü realitesi ile bu konuda yapılan değişikliklere göre uyarlamayı amaçlamaktadır. Yargılama Usul Kuralları, ABİHA ile yargılamaların daha hızlı ve daha etkin işlemesini sağlaması beklenmektedir. Yeni yargılama usul kuralları ile Adalet Divanının organizasyonunda Lizbon Reform Antlaşması ile yapılan değişiklikler sonucunda, ön karar yöntemi yargılamalarının 1980lerin sonundan itibaren en kısa sürede sonuçlanması ve Genel Mahkeme önündeki yargılama sürecinin kısalması ile devam eden dava sayısının azalması mümkün olmuştur. Bu makalede, öncelikle yeni yargılama usul kurallarının yapısına ve bu kurallara genel bir bakış açısıyla bakılacaktır. Daha sonra makalenin diğer kısımlarında bu kurallar detaylı olarak açıklanacaktır.
Abstract
The new Rules of Procedure of the European Court of Justice (ECJ) entered into force on 1st of November 2012. The reforms were introduced with the purpose of making the judicial proceedings more simpler and clearer for participants in lawsuit and national courts of the Member States. Furthermore, they intend to accommodate the structure and content of the Rules of Procedure to the reality and changes of the ECJ s caseload. The Rules of Procedure lay down the provisions required to implement and supplement the Statute of the Court of Justice detailed in Protocol No. 3 annexed to the Treaties. The main aim of this article is to give text comprehension on the new rules of judicial proceedings in front of the European Court of Justice. It is anticipated that these new rules will bring cases and trials quickly and efficiently. Preliminary ruling proceedings was the shortest handed down since the end of the 1980s and the General Court managed, to reduce the stockof pending cases and the duration of proceedings thanks to the new amendments on the organisation of the ECJ made by Lisbon Reform Treaty and new Rules of Procedures of the ECJ. In this article, first the structure and general overview of the rules of procedures will be given, subsequently, they will be explained in detail at foregoing parts of the essay.
