Özet

Hesap verebilirlik, katılımcılık ve demokrasinin gereğidir. Demokratik ülkelerde başta siyasiler olmak üzere tüm kamu görevlileri yaptıkları işlerden dolayı kendileri dışındaki bir otoriteye hesap verirler. Siyasiler ve diğer kamu görevlileri gibi hakimlerin de bağımsız olması ve belirli güvencelere sahip bulunması elbette işlerin yürütümü sırasında keyfi davranabilecekleri ve hesap vermekten azade oldukları anlamına gelmemektedir. Hakimlerin bağımsız olmasının gerekliliği, geçmişte onların hesap vermesine tereddütle bakılmasına sebep olmakta ise de günümüzde bağımsızlık ilkesi zarar görmeden ve anayasal güvenceler korunarak hakimlerin de hesap vermesi gerektiği kabul edilmektedir. Ancak hakimlerin bağımsızlık ve tarafsızlık gibi ön plana çıkan meslek gereklilikleri onların hesap verme şeklinin siyasiler veya diğer kamu görevlileri ile farklı olması sonucunu doğurmaktadır.

Abstract

Accountability is the requirement of the participation and the democracy. All public officers, primarily the politicians are accountable to another authority due to the works they made except them in democratic countries. Independence of the judges and the fact that they have certain guarantees do not necessarily mean that they may act arbitrarily during the performance of the works. Neccesity of Independence of the judges, looking at the causes of being hesitant to give their accounts in the past but nowadays, it is recognized that the judges should also be accountable without damaging the principle of independence and by protecting the constitutional guarantees. However,the professional requirements of the judges coming to the fore like independence and impartiality cause the result that the form of accountability of the judges should be different from that of the politicians or the other public officers.
