Özet
Devletler özel hukuku kapsamındaki kanunlar ihtilafı kuralları gereğince yabancıkanunlar söz konusu kural, kamu düzenine aykırı olmadıkça- Türkiyedeki mahkeme- lerde uygulanabilmektedir. Yani gerekli şartlar varsa ulusal yargıçlarımız, bir yabancıhukuk kuralını, kamu düzenine uygunluk denetiminde geçirdikten sonra uyuşmazlıkçözümünde kullanmaktadır. Peki, böyle bir pratik içine giren bir yargıç, söz konusuyabancı kuralın 1982 Anayasasına aykırı olduğunu düşünürse ne yapacaktır? Bu ka- nunu somut norm denetimiyle Anayasa Mahkemesine gönderebilecek midir? Eğergönderebilecekse Anayasa Mahkemesi bu yabancı hukuk kuralını denetleyebilecekmidir? Denetiminin sonunda ne gibi karar verebilir? Bu sorular 70li yıllarda Alman- yada tartışılmıştır. Almanya Yargıtayı yabancı kanunların anayasaya uygunluk dene- timinin mümkün olmadığını, ancak kamu düzeni kavramı içinde dolaylı bir anayasallıkdenetimi yapılabileceğini, Almanya AYMsi ise Bonn Anayasasının Almanyadaki tümkamu gücü uygulamaları için bağlayıcı olduğu görüşünü savunmuştur. Bu makaledesöz konusu görüşler Türkiye hukuku çerçevesinde sorgulanmıştır
Abstract
In principle, the laws passed by any foreign legislatures cannot be reviewed bythe Turkish Constitutional Court. Nevertheless, foreign laws can be enforced by theTurkish courts in compliance with the rules of conflict of laws. According to 1982 Con- stitution, the provisions of the Constitution are fundamental legal rules binding uponlegislative, executive and judicial organs, and administrative authorities and other in- stitutions and individuals, and laws shall not be contrary to the Constitution under nocircumstances. Accordingly, not only the national laws that introduced by the grand national assembly of Turkey, but also the foreign rules enforced by the judicial organsmust conform to the Constitution. In this article, consequence of foreign rules which are inconsistent with the Turk- ish constitution is analysed.The 1982 Constitution regulates various remedies on the purpose of eliminationof the (foreign or national) laws conflicting with the Constitution. These are tradition- ally concrete and abstract control of norms. Among those, concrete control of normswhich involves some problems peculiar to the 1982 Constitution, is a convenient rem- edy to determine the unconstitutionality of the foreign laws. Likewise, the constitu- tional complaint procedure, which entered into force after the constitutional amend- ment of 2010, provides crucial opportunity to clarify this kind of unconstitutionality.
