Victim Status in Criminal Justice System in the Context of Restorative Justice and Victim-Offender Mediation

Özet

Bu çalışmada genel olarak, ceza adalet sistemlerinde fail odaklı geleneksel yakla- şımdan mağdur ve çözüm odaklı yeni yaklaşıma geçiş şeklindeki paradigma değişimiele alınmaktadır. Mağdurun bu evrilme sürecindeki konumunu belirlemek çalışmanıntemel amaçlarından birisidir. Türk ceza adalet sisteminde bir onarıcı adalet kurumuolan uzlaştırma, bu yeni yaklaşımın temel argümanları dikkate alınarak mağdur öznesibağlamında değerlendirilmiş ve bazı önerilerde bulunulmuştur.

Abstract

In this study, the paradigm shift from the offender-oriented traditional approachto the victim and resolution-oriented new approach in criminal justice systems is gen- erally discussed. One of the main objectives of the study is to elucidate of the victim sposition in this evolving process. Victim-offender mediation is regulated in Turkishcriminal justice system as an institution of restorative justice.
