NAPOLEON DÖNEMİ CONSEIL D'ETAT VE İLK ŞURA-YI DEVLET

Özet
Fransız Devrimi'yle ilga edilen Conseil d'Etat (Devlet Konseyi), Napoleon Bonaparte tarafından yeniden kurulmuş ve iktidarı kendi elinde toplamanın bir aracı olmuştur. Bu dönemde Konsey, yönetime, yasamaya ve kısmen de yargıya ilişkin yetkilere sahiptir. Osmanlı Şura-yı Devleti'nin kuruluşunda da Fransız Devlet Konseyi örnek alınmış; Tanzimat'ın yeniden inşa sürecinde etkin rol oynamıştır.Her iki kurumun da modern devletin "kural koyma" gibi en önemli işlevlerinden birini birincil derecede yerine getirdiği görülmektedir. Her iki kurum da iktidarın merkezileşmesi açısından önemli rol oynarken Fransa'da Konsey, Napoleon'un iktidarını bakanlıklar ve bürokrasiye karşı mutlaklaştırırken; Osmanlı'da Şura, Padişahın mutlak otoritesini bürokrasi lehine yumuşatmak için tasarlanmıştır. Fransa'da Şura, idareyi/yürütmeyi adliyeden kaçırmak için vardır. Osmanlı'da ise Şuranın varlık nedeni adliyenin idareden kurtarılmak istenmesidir. Her iki kurum da mahkeme olarak tasarlanmamıştır. Bugün bu kurumların oynadığı rol, devlet, hukuk devleti ve demokrasi olgularının değişimiyle ilgilidir. Kuruldukları zaman itibariyle her iki kurum da idari yapı içerisinde yer almakla birlikte aktif idare değillerdir. Kurumlara asıl niteliğini veren danışma ve yasama benzeri görevleri olmuştur. Bu sebeple söz konusu kurumların ve özellikle Şura-yı Devlet'in parlamentarizmin gelişmesi başlığı altında da incelenmesi gerekmektedir.
Abstract
The Council in France that was repealed with French Revolution was re-established by Napolean Banaporte and was a tool of gathering power in their own hands. The Council in France had authority in relation to the administration, legislation and partly to the juidiciary in that period. It was taken example for The French Council of State in the establishment of The Council of Ottoman State; it played an effective role in the process reconsruction of Tanzimat.?It is seen that both institutions meet one of the most important functions of the modern state as rule - making. Both institutions played important role in terms of the centralization of power. But, when The Council in France absoluted to power of Napoleon against ministries and goverment, The Council in Ottoman was designed for use in favor of bureaucracy to the absolute authority of The Sultan (padishah). The Council in France is for keep away administration and executive power from the courthouse. In contrast, reason for the existence of The Council in Ottoman is that is wanted to be saved the courthouse from administration.?Both institutions werent designed as court. Today, role of these institutions relate to change of phenomenon of democracy, state of law and state. At the same time, institutions are located in the administrative structure but they are not active role in administration. Legislative and advisory functions are that given the actual quality to institutions. For this reason, it will be necessary that these institutions and especially Council of State are reviewed under the heading of parlementarizm development.?.
