Özet
Heterolog döllenme teknikleri ve evlât edinme kurumunun işlevsellik kazanmasıylaberaber temel insan haklarından biri olan kökenini öğrenme hakkının, gerek Avrupaİnsan Hakları Mahkemesinde gerekse de Kıta Avrupası ülkelerinde yargı kararlarınadaha sık konu olmaya başlaması, bu hakkın niteliği ve kullanılması ile ilgili doktrindeayrıntılı çalışmalar yapma ihtiyacını beraberinde getirmiştir. Ancak asıl mesele sözkonusu hakkın kavram olarak tanımlanmasından ziyade, çatışan menfaatler karşısındasınırlarının tespiti noktasında ağırlık kazanmaktadır.İsviçre Federal Mahkemesi 2002 yılında verdiği bir karar ile kökenini öğrenmehakkını, feragat edilemez ve hak düşürücü bir süreye bağlı olmayan mutlak niteliktebir kişilik hakkı olarak tarif etmiştir1 . Bu çalışma ile çevirisini yaptığımız İsviçre FederalMahkemesinin 2008 yılında verdiği karar (BGE 134 III 241) ise, kökenini öğrenmehakkının çatışma hâlinde olabileceği vücut bütünlüğü hakkını, soybağı davalarındatalep edilen genetik testler sebebiyle yalnızca fiziksel sağlığın ihlâli boyutuyla değil,aynı zamanda psikolojik sağlığın ihlâli boyutuyla da ele aldığı için dikkat çekicidir. Bizde bu çalışma ile hukukî soybağının, genetik soybağı ile örtüşme sağlamadığı alanlardasöz konusu olan kökenini öğrenme hakkına ilişkin genel ve kısa bilgiler verdiktensonra, Federal Mahkeme kararı çerçevesinde bu hakkın vücut bütünlüğünün ihlâlikarşısındaki uygulamasına ilişkin kısa değerlendirmelerde bulunduk.
Abstract
The right to know one s origin is a one of the fundamental human right, whichbegan to be discussed recently by functionalization of the artificial inseminationtechniques and adoption, and also began to be subject in both the European HumanRights Courts as well as in the decisions of Western European countries. And it has created a requirement of new academic studies about the scope and application ofthis right. But the main theme is not only defining the right, but also determining thelimits of the right in terms of the conflicting interests. In Switzerland, the Federal Court in its decision in 2002 for the first time describedthe right to know one s origin as a absolute personality right which can not be waivedand limited with a period of prescription. The Swiss Federal Court decision given in2002, described the right to know the one s origin, as an absolute personality right thatcan not be waived and not due to a prescription period. In this study, the decision of theSwiss Federal Court given in 2008, (BGE 134 III 241), that we translated, is noteworthyas it handles the violation of the right of the body integrity by the requested genetictesting in the lineage cases, which can be in conflict with the right to know one sorigin, within the frame of not only physical health, but also the psychological health.With this study, we have made assessments about the application of this right in viewof the violation of body integrity after giving general and brief information regardingthe right to know one s origin that exist in case of the legal paternity does not matchwith the genetic paternity
