Özet

Roma Hukukundaki permutatio, Roma-Germen temelli bütün hukuk sistemlerinde, trampa veya mal değişim sözleşmesi adıyla günümüze değin varlığını korumuştur. Bu çalışmada, Roma Hukukundan günümüze permutatio kurumunun kısa değerlendirmesine yer verilmiş; Türk Hukuku yanı sıra, Fransız, Alman ve İsviçre hukuklarında, trampa hükümleri incelenmiştir. Daha sonra, mal değişim sözleşmesinin ekonomik öneminden bahsedilmiştir. Paranın icadı üzerine satış sözleşmesinin arkasına itilen mal değişim sözleşmesi, ekonomik buhran dönemlerinde, hep kurtarıcı ve düzenleyici görev üstlenmiştir. Bu itibarla, hâli hazırdaki trampa ihtiyacının yakın gelecekte ivme kazanacağı öngörülmüştür.

Abstract

Barter (or commodity swap), in other words good exchange contract, based on the institution named (in Latin) permutatio of Roman law has maintained its existence in Roman-Germanic legal systems until today. In this article, has been given a short assessment of this Roman law institution called permutatio; as well as Turkish law, also French, German and Swiss law has been touched on. Then, the economic importance of the good exchange contract is mentioned. The invention of money had pushed the good exchange contract to the back of the sale contract. However, in times of economic crisis, good exchange contract had always assumed savior task and regulatory role. In this regard, the present prediction about this contract is to accelerate with momentum in the near future.
