Özet

Ülkemizde merkezi idarenin taşra örgütlenmesini şekillendiren temelyasa 5442 sayılı İl İdaresi Kanunudur. Valiyi, “İl genel idaresinin başı ve mercii(md.4)” olarak niteleyen Kanun, valinin hukuksal durumunu 9. maddesindedüzenlemiştir. Buna göre vali “İlde Devletin ve Hükümetin temsilcisi ve ayrı ayrıher Bakanın mümessili ve bunların idari ve siyasi yürütme vasıtasıdır.” Bunakarşın Kaymakam, “ilçe genel idaresinin başı ve mercii olup, ilçede hükümetintemsilcisidir (md.27)”. Kanun metninde geçen “Devletin temsilcisi olmak” ve“hükümetin temsilcisi olmak” kavramları hukuken çok net ayrılabilen kavramlarolmadığı gibi hangi görevlerin devleti temsil, hangi görevlerin ise hükümeti temsilyetkisinden doğduğu tartışmaya açık bir konudur. Türk idare hukuku akademikaraştırmalarında çok fazla üzerinde durulmayan bu konu hakkında İl İdaresiKanunu ve konuyla ilgili diğer mevzuatta da açık bir bilgi yoktur. Bununla beraberKanunda valiler için tanımlanan ayrı ayrı her Bakanın “siyasi yürütme vasıtası”ifadesinin nasıl yorumlanacağı da tartışmaya açıktır.

Abstract

The main Law forming the provincial organization of central administration in Turkey is the Law No: 5442 on Provincial Administration. The Law defining the governor as “The head and authority of Provincial general administration (Article 4)” regulates the legal status of governor in Article 9. Accordingly, the governor is the “Provincial Representative of the State and the Government and provincial representative of each Minister and the administrative and political executive instrument of them at provincial level.” On the other hand, District Governor is “the head and authority of general administration and represents the government in the district (Article 27)”. As the concepts cited in the Law text as “being representative of the State” and “being representative of the government” are not legally distinctive, the issue of which responsibilities rise from the authority of representation of the state and which ones from the representation of government is open to discussion. No clear information is found in Provincial Administration Law and in the other relevant legislations on this issue not being emphasized much in the academic studies regarding Turkish administrative law. In addition, how to interpret the statement related to governors as being “politically executive instrument” for each minister separately is also open to discussion.
