SAYIŞTAY YARGISININ ETKİNLİĞİ

Özet

Sayıştay, kuruluş felsefesi yönünden kamu kaynaklarının hukuka, etikilkelere ve toplumsal vicdana uygun şekilde sarf edilmesini têmin etmek üzerefaaliyet gösteren köklü bir kamu idaresidir. Modern kamu mâli yönetimi diliyleSayıştay, bütçe hakkının vücut bulmuş hâlidir. Mali ödev ve yükümlülükleriniyerine getiren vatandaşlar, bunun karşılığında devlet bütçesinin kamu yararı vekamu menfaati için harcanmasını isteme ve hesap sorma hakkına sahiptirler.Bütçe hakkı denen bu hak, vatandaşlar namına Türkiye Büyük Millet Meclisininvekâletiyle Sayıştay tarafından yerine getirilmektedir. Bütçe hakkının en iyişekilde kullanılabilmesi, etkin bir Sayıştay yargısı ile mümkündür. Hesap yargısıda denen Sayıştay yargısının etkinliği, yargılamaya esas denetim raporlarınınusûl ekonomisine uygun şekilde karara bağlanıp ilamların en yüksek oranda infazedilmesiyle sağlanacaktır. Yanı sıra etkin bir yargılama için yargılama faaliyetininöncülü ve ayrılmaz parçası niteliğindeki Sayıştay denetimi de en optimum düzeydegerçekleştirilmelidir. Bu çalışmada Sayıştay yargısının mevcut etkinlik düzeyiincelenecek ve daha etkin bir Sayıştay yargısı için öneriler ortaya konacaktır.

Abstract

The Turkish Court of Accounts is a well-established public administration operating in order to ensure that public resources are used in accordance with the law, ethical principles and social conscience in terms of its founding philosophy. In the modern language of public financial management, the Turkish Court of Accounts is the embodiment of the budget right. Citizens who have fulfilled their financial duties and obligations have, in return, the right to demand and account for the expenditure of the state budget for the public interest and public benefit. Called the budget right, this right is fulfilled by the Turkish Court of Accounts with the power of attorney of the Grand National Assembly of Turkey on behalf of the citizens. The best exercise of the budget right is possible through an effective the Turkish Court of Accounts judgment. The effectiveness of the Turkish Court of Accounts’s judiciary, which is also called account judgment, will be ensured by the decision of the audit reports based on the proceedings in accordance with the procedural economy and the execution of the proceedings at the highest rate. In addition, for the effective trial, the audit of the Turkish Court of Accounts, which is the precursor and integral part of the trial activity, should be carried out at the optimum level. In this study, the current effectiveness level of the Turkish Court of Accounts will be examined and suggestions will be propounded for a more effective Turkish Court of Accounts.
