Özet

Amaç: Yakın zamanda biyo-teknolojide yaşanan gelişmelerle beraber, bir dizi tıbbi yardımla üreme tekniği gündeme gelmiştir. Bu çalışmada, tıp etiği ve hukuk çerçevesinde oluşan tartışmayı, çeşitli ülke ve vaka örneklemleriyle aktarmak ve konunun çok yönlülüğünü, bu örnekler üzerinden göstermek amaçlandı. Bu derlemede, yardımcı üreme tekniklerinin yarattığı sorun alanlarından başlıcaları ele alındı, farklı ülkelerde nasıl gündeme geldiği ve yapılan düzenlemeler konusuna dair genel bir bakış sunuldu. Yardımcı üreme teknikleri ile ilgili tartışma ve kararların, bireysel vicdana ya da tıp etiğine bırakılamayacak kadar geniş imalara sahip olduğu görülmüştür. Konunun, “annelik”, “babalık”, “hayat ve ölüm”, gibi temel kavramlarla ilgili tartışma açması sebebiyle evrensel yönleri olduğu gibi aynı zamanda, bu tekniklerin hangisinin ahlaka uygun, hangisinin uygun olmadığı konusunda bir fikir birliği olmadığı ve yasal düzenlemelerin de ülkelere göre farklılıklar gösterdiği ortaya çıkmıştır.

Abstract

With the recent developments in the biotechnology, a series of techniques for assisted conception have become available. In this study, we aimed to debate the conflict in this era within the scope of medical ethics and law, by giving various case records and events from different countries to show the various aspects of the subject with these samples. In this study, controversial issues in and the solutions in different countries are debated. In the end of the study, it's been concluded that the arguments and decisions about the assisted reproductive techniques could not been solved by individuals conscience or medical ethics. This argument is universal as it includes the concepts of "motherhood", "fatherhood", "life and death" and it also varies between countries because of the variation of the legal arrangements and lack of common sense about the moral convenience of the techniques.
