Osmanlı devletinde kadınların şer'i mahkemeleri kullanması (Kayseri örneği)

Özet

Ailenin önemli bireylerinden biri olan kadının şer’i mahkemeleri kullanmasını konu edindiğimiz bu çalışmada, 17. yüzyıl Kayseri’sinde mahkemeye yansıyan konular bağlamında, kadının toplumdaki statüsü, haklarını kullanması ve sosyo-ekonomik yapıdaki durumu ele alınmıştır. Yapılan çalışmanın sonunda uğradığı haksızlıkları adalet önünde çözen, malını mülkünü istediği gibi satabilen, sahip olduğu hakları sonuna kadar kullanabilen bir kadın modeli karşımıza çıkmıştır. Çalışmamızın temel kaynağını Osmanlı tarihi ve kültürünün hukukî, içtimaî ve siyasî kaynakları olan Kayseri Sancağına ait Şer’iyye Sicilleri oluşturmuştur.

Abstract

One of the important subjects of the family courts to use the Shari’a Courts the issue of women in this study, we have received, 17th century in Kayseri in the context of the issues reflected in the courts, the status of women in society, the rights to use, socio-economic status are discussed. In justice to solve the injustices suffered by the goods sold as the property you want, that has the rights until the end of a model that can present as was a woman. Ottoman history and culture of our study, the main source of legal, social and political resources that belong to the City Sanchez has established Shari’a Court Records.
