Özet
Modern demokratik siyasal sistemlerde siyasi partiler, vazgeçilmez ve temel unsurlar olarak kabul edilir ve demokratik siyasal sistemin gelişiminde ve işleyişinde de önemli roller üstlenirler. Bu rollerden biri; günümüz temsili demokrasi uygulaması çerçevesinde siyasi partilerin seçimler yoluyla siyasal iktidarı elde etmek veya ortak olmak amacıyla sürdürdükleri faaliyetlerdir. Bu faaliyetlerin önemli bir bölümü şüphesiz partilerin milletvekili adaylarınca ya da onlar üzerinden yürütülmektedir. Bu nedenle siyasi partilerin milletvekili adaylarının kimler olacağı hususu oldukça önem kazanmaktadır. Bu noktada partilerin seçimlerde gösterecekleri milletvekili adaylarının belirlenmesi konusu dikkat çekici bir yer edinmektedir. Bu hususun önem arz etmesindeki temel unsur; demokratik siyasal sistem için oldukça büyük önem taşıyan ve hatta demokrasinin olmazsa olmaz koşulu olarak tanımlanan siyasi partilerin milletvekili adaylarının belirlenmesinde kullandıkları usullerin demokratik ilke ve teamüllere ne derece uygun olduğudur. Genel itibariyle Türkiye’de siyasi partilerin milletvekili adaylarının belirlenmesinde farklı usuller uygulanmaktadır. İşte bu çalışmada; Türkiye’de siyasi partilerin milletvekili adaylarının hangi usul veya usullerle belirlendiği, bu usullerin içerikleri ve bu çerçevede konu açısından büyük önem taşıyan 1983 tarih ve 2820 sayılı Siyasi Partiler Kanunu’nun (SPK) ilgili hükümleri ve bu hükümlerde tarihsel süreçte gerçekleştirilen değişikliklerin değerlendirilmesi ve sonrasında olarak Adalet ve Kalkınma Partisi (AK Parti), Cumhuriyet Halk Partisi (CHP) ve Milliyetçi Hareket Partisi’nin (MHP) tüzükleri çerçevesinde milletvekili adaylarını belirleme usullerinin nasıl gerçekleştiğinin incelenmesi amaçlanmaktadır.
Abstract
In Modern democratic political systems, political parties are considered indispensable and essentialelements and Political parties assume crucial roles in the development and functioning of democratic politicalsystem. One of these roles pertains to activities performed to obtain political power or be a partner in theexercise of political power through political elections in the framework of the practice of today’s representativedemocracy. A majority of these activities are undoubtedly carried out by deputy candidates of political partiesthemselves or under their auspices. Therefore, who will be deputy candidates of political parties turns to be amatter of particular importance. At this juncture, the nomination of deputy candidates for elections enters intothe picture as a salient issue. The main element of the importance of this issue is the degree to which theprocedures used by the political parties in determining the candidates of deputies, which are very important forthe democratic political system and which are even defined as the essential condition of democracy, are inaccordance with the democratic principles and practices. In General, different procedures are applied indetermining the candidates of deputies of political parties in Turkey This study aims to analyze whichprocedures are applied to the nomination of deputy candidates of political parties in Turkey, contents of theseprocedures and (the relevant provisions of the law on political parties (LPP) No. 2820 of 1983, which is ofgreat importance for the subject, and the changes made in these provisions in the historical process will beevaluated and lastly, procedures for the nomination of deputy candidates in the framework of bylaws of Justiceand Development Party, Republican People’s Party and Nationalist Movement Party.
