Abstract
The Anti-Terror Law No. 3713 stirred up various debates since its coming into effect, was amended several times and some of its clauses were annulled by the Turkish Constitutional Court. The crime that was both stipulated in domestic law and was subject to court cases at and decisions of the European Court of Human Rights has always aimed to punish the disclosing, publishing or targeting of the public officials that served in the struggle against terrorism. As such, the regulation aims to protect the right to life or physical integrity of the public officials. The victim of the crime has to be someone who served in the struggle against terrorism. However, in practice, the term “serving in the struggle against terrorism” is interpreted too broadly, which causes problems. This term should be interpreted in a narrower manner to signify the public officials who served actively in the struggle against terrorism or provided intelligence support. Meanwhile, the punishment of disclosing or publishing of the identities of public officials leads to decisions that violate freedom of press and the right to seek legal remedies, in practice. This study elaborates on the aspects of this crime, related judicial decisions and recommendations on the challenging aspects of the regulation, while analyzing broadly the links between the crime and freedom of press.
