Özet

Yabancı mirasçılık belgelerine dayanılarak Türk ticaret sicillerinde tescil işlemi yapabilmesi için yabancı mahkemelerden edinilen mirasçı-lık belgelerinin Türkiye’de mirasçılık belgesi niteliği kazanması gerekir. Mirasçılık belgesi yabancı idarî mercilerden alınmışsa, bu belge, verildi-ği devletin yetkili makamınca ya da verildiği devlet ülkesindeki Türk konsolosluğunca tasdik edilirse ya da apostille şerhi taşırsa Türk huku-kunda da mirasçılık belgesi vasfı taşıyan bir resmî belge olarak kabul edilir. İdarî mercilerden alınmış mirasçılık belgesine, milletlerarası an-laşmalar vasıtasıyla ipso iure (tasdik veya şerh gerektirmeksizin) resmi-yet tanınmış da olabilir. Mirasçılık belgesi yabancı mahkemeden alınmışsa, bu belgenin Türk hukukunda mirasçılık belgesi olarak kabul edi-lebilmesi için tanınması gerekir. Yabancı çekişmesiz yargıda verilen mirasçılık belgelerinin sadece şeklen kesinleşmesinin, maddî kesin hü-küm kesbetmemesinin tanımaya engel olduğu görüşünde olan yazarlar ve Yargıtay kararları bulunmasına rağmen, doktrindeki ve içtihattaki ağırlıklı görüşe göre, mirasçılık belgesinin verildiği devlet hukukunda çekişmeli ya da çekişmesiz yargıda edinilmiş olması tanınma kabiliyeti-ne etki etmez. Bu usûllerle tanınan veya tasdik edilen yabancı mirasçılık belgeleri mirasçılığa karine teşkil eder ve ticaret sicillerinde tescile da-yanak oluşturabilir.

Abstract

Turkish trade registy offices register succesion of shares if provid-ed with certificates of succession having the effect of presumption of correctness. However, foreign certificates of succession do not have such an effect in Turkish law, unless they are legalized or recognized. Foreign certificates should –in principle- be legalized if issued by a for-eign administrative authority. Legalization requires the approval of the authentication authory of the state of issue or of the Turkish consulate in the country of issue. According to some international treaties, foreign public documents are exempt from legalisation requirement. Depending on the wording of the treaty, the foreign certificate may have the effect of presumption of correctness ipso iure, or by bearing only an Apostille. Certificates of succession should be recognized if issued by a foreign court. There are some cassation court cases and some authors who deny the possiblity of recognition of foreign certificates of succession, if given in non-contentious court proceedings. In support of their position, they put forth the lack of res iudicata effect of such certificates. Yet accoring to the majority of the legal literature –and according to the author of this article- foreign certificates of succession may be recognized by Turkish courts, if they are definitive in the country of issue.
