Özet
Tahkim yargılamasında hakemler, taraflardan bağımsız ve tarafsız olmalıdırlar. Hakemlerin tarafsızlık ve bağımsızlık yükümlülüklerinin ihlali, hakemin reddi sebebidir. Taraflar, tarafsızlıkları ve bağımsızlıkları hakkında haklı şüpheye sahip oldukları hakemi reddedebilirler. Hakemin reddi sebepleri, Hukuk Muhakemeleri Kanununda (HMK) düzenlenmiş- tir. Hakem olarak seçilen gerçek kişi, bu görevi kabul etmeden önce ta- rafsızlık ve bağımsızlığından şüphe edilmeyi haklı gösteren durum ve koşulları açıklamak zorundadır (HMK m. 417/ I). Ret talebine konu olan her bir olayın özellikleri dikkate alınarak hakemin reddi hakkında karar verilmesi gerekmektedir. Hısımlık, gerçek kişiler arasında kan bağından veya Kanunda öngörülen hukuki işlem ve ilişkilerden doğan ve hukuk düzeni tarafından kendisine bazı sonuçlar bağlanan yakınlık ilişkisidir. Çalışma konusunun esasını hısımlığın hakemin reddi bakımından sonuç- ları oluşturmaktadır. Bu çalışma, hangi hısımlık ilişkilerinde hakemin tarafsızlık ve bağımsızlığının ihlali sebebiyle reddedilebileceği ve bunun usulünü ele almaktadır.
Abstract
Arbitrators should be independent from the parties and impartial during arbitration trial which is an alternative dispute settlement met- hod. The breach of obligations to be impartial and independent is a rea- son for challenge of an arbitrator. The grounds of challenge for arbitra- tor are defined in Turkish Code of Civil Procedure (TCPC, HMK). The person selected as an arbitrator shall disclose the circumstances and matters that justify doubt over his impartiality and independence, prior to accepting the duty (TCPC a. 417/ I). An arbitrator may be challenged only if circumstances exist that give rise to justifiable doubts as to his impartiality or independence, or if he does not possess qualifications agreed to by the parties. The parties can challenge an arbitrator whom they have justifiable doubts about his impartiality and independence. Parentage is a line of descent between real persons stemming from kin- dredness or legal transactions and relationships established by law. Domestic legal orders consider parentage as a line of descent that has important consequences. The main topic of this study deals with conse- quences of parentage in terms of challenge of an arbitrator. The deci- sion on challenge of an arbitrator should be given through considering particularities of each situation that is the subject of challenge. This work discusses in which situations an arbitrator can be challenged due to the breach of obligations to be impartial and independent and the procedure of this challenge.
