Özet
Anayasamızın 24. maddesinde din ve vicdan özgürlüğü ile ilgili düzenleme, gerçek kişilerin din anlamındaki özgürlüğünü güvence altına almaktadır. Bu noktada 18 yaşından küçük gerçek kişilerin de din ve vicdan özgürlüğüne sahip olacağını kabul etmek gerekir. Bunun sebebi çocuklara da hukuk düzeni tarafından kişi olması nedeniyle bir takım hakların ve özgürlüklerin verilmiş olmasıdır. Çalışmamızda çocukların din ve vicdan özgürlüğünü, inceleme konusu yapacağız. Doğal olarak Anayasamızdaki temel hükümden ve Türk Medeni Kanunu’ndaki vela-yete ilişkin hükümden hareket edeceğiz. Bununla birlikte çeşitli uluslara-rası sözleşmelerin ilgili maddelerine konu ile ilgisi olduğu kapsamda değinilecektir. Ayrıca Almanya ve İsviçre’deki dini eğitim ile ilgili dü-zenlemelerin ve Avrupa İnsan Hakları Mahkemesinin çalışma konumuzla ilgili kararlarının incelenmeye değer olduğunu düşünmekteyiz. Son olarak değerlendirmelerimizi ve önerilerimizi sunacağız.
Abstract
The regulation on freedom of religion and conscience in Article 24 of our Constitution guarantees the freedom of real persons in terms of religion. At this point, it should be accepted that real persons under the age of 18 will also have the freedom of religion and conscience. The reason for this is that some rights and freedoms are given to children by the legal order because they are persons. In our study, we will examine the freedom of religion and conscience of children. Naturally, we will proceed from the basic provision in our Constitution and the provision regarding custody in the Turkish Civil Code. In addition, the relevant articles of various international conventions will be mentioned within the scope of their relevance to the subject. In addition, we think that the regulations on religious education in Germany and Switzerland and the decisions of the European Court of Human Rights regarding our work are worth examining. Finally, we will present our evaluations and sug-gestions.
