Özet

Bu makalede Dünya Bankası, Uluslararası Para Fonu, Dünya Ticaret Örgütü, Uluslararası Çalışma Örgütü gibi uluslarararası ekonomi hukuku kurumları ile adalet ve kalkınma arasındaki ilişki ele alınmaktadır. Bahsedilen bu kurumların temel amaçları ve bilhassa bu amaçlara hizmet edip edemedikleri, dünyada adil bir düzen sunabilme yönünde faaliyetleri olup olmadıkları tartışılmaktadır. Neoliberalism ile birlikte güçlenen küresel kapitalizmin etkisiyle gelişmiş dünya ülkeleri ile diğer ülkeler arasındaki ekonomik uçurum gün geçtikçe derinleşmektedir. Dolayısıyla, bu makalede neoliberalizmin kalkınmayı nasıl etkilediği de değerlendirilmektedir. Kalkınma ve adalet arasındaki gün geçtikçe zayıflayan ilişki de gösteriyor ki uluslararası ekonomi hukuku da sadece birinci dünya ülkelerinin çıkarlarına hizmet etmektedir.

Abstract

This article discusses the relationshipbetween the legal institutions ofinternational economic law and justice anddevelopment. The international economiclaw institutions such as the World Bank, theInternational Monetary Fund, the WorldTrade Organization and the InternationalLabour Organization and their main aimswill be discussed briefly. Then, it will bequestioned that what is the target of theselegal institutions that is human rights orjustice and development. Do the effectsof these legal systems spread fairly all overthe world? Additionally, global capitalismhaving been strengthened by neoliberalismdeepens the economic gap between thedeveloped world countries and the restof the globe. Hence, it will be indicated towhat extent the neoliberalism effects ondevelopment. Further, these institutionsserve a quite successful mechanism forensuring justified economic developmentwithin the first world countries. Theydirectly show weakening relationshipbetween development and justice, becauseinternational law has always served for theinterests and concerns of the first worldcountries not for the developing countries.
