Türkiye' de kadın işçilerle ilgili koruyucu yasal düzenlemeler ve 4857 sayılı yeni iş kanunu ile getirilen yenilikler

Özet
Türkiye 'de 1990 yılı Nüfus Sayımına göre 27 milyon olan kadından sadece 6.5 milyonu yani yaklaşık %23 'ü işgücüne katılmaktadır. Kadın işgücünün yaklaşık %81 'i tarım sektöründe çalışmaktadır. Kadınlar sanayide çalışanların %11'ini, hizmetler sektöründe çalışanların %12 sini oluşturmakladır. Özellikle sanayi sektöründe bu düşük katılım kadınlar için eşit olmayan istihdam fırsatlarının bir sonucu olarak görülmektedir. Kadınlar çalışma hayatının yanında ev hayatı ve aile sorumluluklarını da üstlenmektedirler. Bu nedenle kadın işçilerle ilgili koruyucu düzenlemeler onların bu iki sorumluluk alanlarını dengelemesi açısından oldukça önemlidir. Bu çalışmada Türkiye 'de kadın çalışanların gelen olarak profili çizilmiş, kadın işçiler konusundaki düzenlemelerden bahsedilmiş ve 4857 sayılı yeni İş Kanunun kadın işçilere getirdiği yenilikler detaylı olarak incelenmiştir.
Abstract
According to 1990 Census in Turkey, 6.5 million women out of 27 million contribute to the labour force with a 24% share. Agriculture is the most common sector with a rate of 81% for women. Not only they represent 11% of the workforce in industrial sector, but also women represent 12% in service sector. This low rate of women participation to the labour force is to be seen as a result of unequal employment opportunities for women. Women workforce always used to be secondary workforce and specialities of women workers in the labour market could not be eliminated. Traditional view to women gives prior consideration to being wife and mother. As they are given permission to work only for economic reasons; this supported their image as secondary labour force. In addition to dealing with business life, women also have to deal with family responsibilities and house works. Therefore, protective regulations related to women workers are very important for balancing to their responsibility area. In this study general profile of women workers in Turkey has been analysed, national and international regulations related to working women have been examined and Labour Law No: 4857 is analysed in respect of innovations for women workers.
