Özet
Fıkıhta bilgi, nass zeminde ve vahiyle çelişmeden gerçekleştirilir. Bilgidekesinlik önceliklidir. Fıkıh usûlü, kesin bilgiye götüren kaynaklara ulaş-ma çabası içindedir. Bu kaynaklara delîl denmektedir. Fıkıh usûlcüleri,delîl ile elde edilen bilginin değerini tespit için, delîlleri sübûtu ve delâletiaçısından değerlendirmişlerdir. Kurân ve mütevâtir Sünnet katî delîl,âhâd haber ve fıkhî kıyâs da, zannî delîl sayılmıştır. Katîlik ve zannîlik,delîller arası öncelik sırasını gösterdiği gibi, onlardan elde edilecek bilgile-rin bağlayıcılık derecesini de açıklamaktadır. Başlangıçta Fıkıhın yönte-mi, cuveynîde görülen, Arapça Dilbilgisine dayalı cedel Kıyâsıdır. Üreti-len yeni bilgi katî (kesin) değildir. Fıkıh Bilimi yoktur. Kesin bilgi, burhânîbilgidir. Ğazalî, Fıkıh usûlünün yöntemini Burhân Kıyâsı yapmıştır. Buşekilde, Fıkıh Bilimini kurmuştur. Ancak, Fıkhî Kıyâsı, Burhân Kıyâsınadönüştüren form ve yöntemleri açıklamamıştır. Bu araştırma, günümüzekadar ele alınmamış, zannî Fıkhî Kıyâsı katî Burhan Kıyâsına dönüştü-ren bu form ve yöntemleri ortaya koymuştur. Elde edilen bulgu ve yargı-lar, Giriş, üç Bölüm ve Sonuç içinde sunulmuştur.
Abstract
In Islamic Law (Fiqh), knowledge is achieved on the basis of canonic textsand without any contradiction. Accuracy of the knowledge is the priority.Jurisprudence (usul al-Fiqh) endeavors reaching the sources which leadthe faqih (jurisprudent) to the accurate knowledge. Aiming the detection ofvalue of the knowledge which is based on evidences, Jurisprudents haveevaluated the evidences due to their certainty and implication. Quran andmutawatir sunna are conclusive evidences while ahaad hadith and qiyas(jurisprudential measurment) are suppositive evidences. conclusivenessand suppositiveness show us the order of priority among the evidences.On the other hand these two criteria explain the degree of bindingness. Inthe beginning the method of Fiqh is Qiyas of Jadal (Measurment of Debate)based on Arabic Grammar, as we see in the example of cuwayni. Here,the new-product knowledge is not conclusive. There is no Fiqh. The ac-curate knowledge is the provable one. Then Gazzali came and brought the Qiyas of Burhan (Measurment of Evidence) on. This is how he establishedFiqh as a discipline. Yet he has not explained the forms and methods heused for converting the Jurisprudential Qiyas to the Qiyas of Burhan. Thisstudy aims explaining these forms and methods. The results obtained arepresented in five parts; introduction, three chapters and the conclusion.
