BEDENSEL ZARAR HÂLLERİNDE ÖDENECEK TAZMİNATIN BELİRLENMESİNDE ÖZEL BİR İNDİRİM SEBEBİ: ZARAR VERENİN MALÎ DURUMUNUN KÖTÜLEŞMESİ VE HAKKANİYET İNDİRİMİ

Özet
Hukuka aykırı ve kusurlu bir fiil sonucu başkasının vücut bütünlüğünü ihlal suretiyle zarara sebep olan kimsenin bu zararı gidermekle yükümlü olması, yalnızca haksız fiil sorumluluğunun değil hakkaniyetin de bir gereğidir. Bu çerçevede; vücut bütünlüğünün ihlaline bağlı olarak gerçekleşen zararların tazminini ele alan çok sayıda düzenleme mevcuttur. Bu düzenlemelerden biri de Türk Borçlar Kanunu’nun 55. maddesindeki tazminatın miktarını esas alarak herhangi bir hakkaniyet indirimi yapılamayacağı yönündedir. Söz konusu düzenleme çerçevesinde; tazminat miktarının ve kapsamının belirlenmesine ilişkin 50 ve 51. maddeler, tazminat miktarının hangi hâllerde azaltılabileceği, hâkime tanınan takdir yetkisinin kapsamı ve indirimin yapılıp yapılmayacağına ilişkin 52. madde hükümleri, bedensel olarak zarar gören kişiye ödenecek tazminatta yapılacak indirimin hakkaniyete uygun olup olmadığı uzunca süre tartışılmıştır. Kanaatimizce; söz konusu indirim, hakkaniyet amaçlı olmayıp miktar esaslı keyfi indirimleri önlemek içindir ve sadece, zarar verenin tazminat ödemesi sonucunda ekonomik durumun kötüleştiği durumlarda uygulama alanı bulmaktadır. Bu sebeple söz konusu madde, sınırlı hâllerde uygulanmalı ve dar yorumlanmalıdır.
Abstract
The liability of a person who causes damage by violating the bodily integrity of another person as a result of an unlawful and faulty act is not only a requirement of tortious act liability but also of equity. In this context, there are many regulations that deal with the compensation of loss caused by the violation of bodily integrity. One of these regulations is the regulation that no equity reduction can be made based on the amount of compensation in Article 55 of the Turkish Code of Obligations. Within the framework of the said regulation in question, Articles 50 and 51 on the determination of the amount of compensation and the scope of the compensation, in which cases the amount of compensation can be reduced, the scope of the discretion granted to the judge and the provisions of the article 52 on whether the reduction will be made, whether the reduction to be applied to the compensation to be paid to the physically injured person is equitable or not has been discussed for a long time. In our opinion, the said discount does not have a equitable purposes, but to prevents arbitrary discounts on the basis of quantity and it applies only in cases where the economic situation deteriorates as a result of the amount of the compensation paid. For this reason, the said article should be applied in specific situations and should be interpreted narrowly.
