Özet

Bu çalışmada, 5224 sayılı Sinema Kanunu’nda yapılan ve 30.01.2019 tarihinde yürürlüğe giren değişiklikler, kökenlerini liberal yaklaşımdan alan Toplumsal Sorumluluk Kuramı ve J.S. Mill’in yararcılık felsefesi bağlamında ele alınmıştır. Özellikle eski ve yeni denetim sisteminin mukayese edilmesi amaçlanmış olup, betimleyici araştırma yöntemine başvurulmuştur. Çalışmanın sınırları gereği, yalnızca denetimle ilgili olan hükümler incelenmiştir. Bu bağlamda, 2004 yılında kurulan denetim sisteminde yapısal bir değişiklik yapılmadığı ancak birtakım eksikliklerin ve sorunların giderildiği saptanmıştır. Söz konusu değişikliklerle birlikte, mevcut film denetim sisteminin Toplumsal Sorumluluk Kuramı’nın öngördüğü ‘pozitif özgürlük’ kavramıyla uyumlu olduğunu söylemek mümkündür. Ancak Kanun’da yapılan değişikliklerde asıl öne çıkan husus, Devletin sinema sektörünün farklı kolları arasında hakemlik rolü üstlenmiş olmasıdır. Bu durumun nedeni sinema sektöründe son yıllarda yaşanan gelişmelerdir. Sinema salonu işletmecisi bir firmanın, Türkiye’deki salonların önemli bir kısmını kontrol etmesi ve bunun sonucunda sinema biletleri üzerinde yapımcı şirketlerin izni olmaksızın promosyon ve kampanyalar yapması ile film öncesinde gösterilen uzun reklamlar toplumun, film yapım şirketlerinin ve sinema sektörü çalışanlarının tepkisini çekmiştir. Böylece, film yapım şirketinin izni olmadan sinema biletleri üzerinde yapılacak tüm kampanyalar yasaklanmış, promosyonlu bilet satışı engellenmiştir. Yine toplumda tepki çeken bir konu olan film öncesinde gösterilen uzun reklamlara da sınırlama getirilmiştir. Bu hususlar her ne kadar sektörün kendi içinde çözmesi gereken konular olsa da kanımızca, sistemin aşırılıklarını giderme amacı taşıyan hukukî düzenlemeler serbest piyasa ilkesi ve yararcı liberalizmin sınırları içerisinde kabul edilebilir. ‘Yumuşak’ ya da ‘elastik’ paternalizm kavramıyla ifade edilebilecek bu anlayış, Devletin ‘makul’ sınırlar içerisinde kalan ve kamu yararını amaçlayan düzenlemeler yapmasına olanak vermektedir

Abstract

In this study, the amendments on Cinema Law No. 5224 entered into force on 30.01.2019 are examined, in the context of John Stuart Mill’s utilitarianism and Social Responsibility Theory whose origins from liberal approach. Particularly, it is aimed to compare the old and new control systems and descriptive research design is preferred. In accordance with the limits of this study, only the provisions related to supervision are examined. In this context, it is determined that there was no structural change in the supervision system established in 2004, but some deficiencies and problems were eliminated. With these changes, it is possible to indicate that the current film supervision system is compatible with “positive liberty” which is a concept stipulated by the Social Responsibility Theory. But, the prominent issue with the amendments on law is that the state has played an arbitrator role from different areas of the cinema sector. The reason for this situation is the developments in the cinema sector in recent years. The way a movie house company controls a considerable portion of movie theaters in Turkey, and as result, presents special offers and promotions along with lengthy commercials before screenings caused backlash amongst movie companies and film industry laborers. Thus, all the campaigns related to cinema tickets were banned and the sale of promotional tickets was prevented without the permission of the film production company. Also, restrictions were placed on the long commercials shown before the film, which is a subject that attracts public reaction. Although these are issues that the industry must resolve within itself, legal regulations aiming to eliminate the excesses of the system can be accepted within the boundaries of free market and Utilitarian Liberalism. This conception, which can be expressed with the concept of “soft” or “elastic” paternalism, allows the state to make arrangements that fall within the “reasonable” boundaries and aim for the public good
