Hukuk kurallarının konulması kadar uygulanması da büyük önem arz etmektedir. Busebeple hukuk bilimcileri uygulamayı kolaylaştırmak üzere kuralların emredici-yedek kuralşeklinde ayrılması fikrini ortaya atmışlardır. Bununla kamu düzeni alanına giren kurallar ile girmeyenleri belirleyerek insan iradesinin hukuk düzeni içindeki hareket alanını tespit etmeyiamaçlamışlardır. Bu yazıda bu ayrımın amacı, emredici-yedek kuralların mahiyeti açıklanmakta,doğurduğu hukuki sonuçlara yer verilmektedir. Bu bilgiler ışığında İslam hukuk sistemi açısındanbu ayrımın mümkün olup olmadığı değerlendirilmektedir

Abstract

The Distinction of Imperative- Contructive Law Rule and The Possiblity of This in Termsof the Islamic LawThe implementation of the rules have importance as the setting rules. Due to this reason lawscientists, have put forward the idea of separation rules as imperative rule and contructive tofacilitate the application. With the determining the rules of public order and not, they haveproposed to identify the movement area human will in legal system. In this paper has beenexplaned the aim of the distinction, the nature of imperative rule and contructive rule and hasbeen given the legal consequences. In the light of this information is considered that this distinctionis possible in terms of the Islamic legal system or not
