Özet

Mallarına haciz konulması ya da haklarında iflas kararı verilmesi ihtimali olan borçlular, uygulamada çeşitlitasarruflarda bulunarak alacaklılarından mal kaçırmaktadır. Borçlunun mevcut malvarlığından alacağınıtahsil edemeyen alacaklı, kendisine zarar veren tasarrufların iptali için dava açabilmektedir. Borçlununhaline münasip evi İcra İflas Kanunu’nun m. 82/I, b. 12 hükmü gereği haczi kabil olmayan malvarlığıdeğerlerinden biridir. Tasarrufun iptali davasıyla borçlunun hangi tasarruflarının iptal edilebileceği doktrinve Yargıtay içtihatlarıyla ortaya konulmakta olup borçlunun haline münasip evini üçüncü bir kişiyedevretmesi halinde, bu işlemin tasarrufun iptali davasına konu olup olamayacağına ilişkin farklı görüşlerileri sürülmektedir.

Abstract

Debtors whose asset is under the prospect of being foreclosured or given decree of bankruptcy may cover their assets from the creditors by conducting miscellaneous dispositions. The creditor, who cannot collect his receivable from the debtor's present assets, has right to file an annulment action of the dispositions which harmed him. Pursuant to the Article 82/I-12 of the Enforcement and Bankruptcy Law, the proper house of the debtor is one of the non-seizable possessions. The doctrine and the precedent of the Supreme Court put forward which dispositions of the debtor can be annulled, and in case of annulment of the dispositions, different opinions are given as to whether this transaction can be subject to the annulment action of the disposition if the debtor transfers his house to a third party.
