Özet

Yetersiz yaşam koşulları nedeniyle özel koruma ve hizmet gerektiren gruplar “dezavantajlı gruplar”olarak tanımlanmaktadır. Engelli insanlar, eski hükümlüler ve terör kurbanları bu gruplar arasındadır.Bu grupların sosyal ve yasal açıdan desteklenmesi sosyal refah devletinin temel görevidir. Sonzamanlarda yasal düzenlemeler yoluyla çeşitli destekler sunulmakta ve bu gruplara koruyucu hükümlergetirilmektedir. Engelli insanlar, eski hükümlüler ve terörizmle mücadelede yaralananlar için devletinçalışma hayatında desteği olmaksızın uygun işler bulmak zordur. Özellikle terörle mücadele edenlerinistihdamı toplum için bir sosyal sorumluluk ve devlet için bir görevdir. Bu noktada özel sektöreuygulanacak yükümlülükler, sosyal sorumluluk açısından değerlendirilebilecek oranlardagerçekleşmektedir. Bu çalışmada, bu dezavantajlı gruplara ilişkin kanuni düzenlemeler üzerindedurulmakta, kamu ve özel sektör düzenlemeleri ayrıntılı olarak ele alınmaktadır. Ayrıca, bazıdeğerlendirmeler ve sorunlar da incelenmektedir.

Abstract

Groups that need special protection and service due to insufficient living conditions are described as “disadvantaged groups”. People with disabilities, ex-convicts and victims of terrorism are among these groups. Supporting these groups in terms of a social and legal is the main duties of the social welfare state. Recently various supports are provided through legal regulations and protective provisions are introduced to those groups. It is difficult to find decent work for people with disabilities, ex-convicts and injuries in combating terrorism without a support of the state in working life. Specifically the employment of the people those who fight against terrorism are a social responsibility for the society and a duty for the state. At this point, the obligations to be imposed on the private sector are realized at rates that can be evaluated in terms of social responsibility. In this study, the law regulations regarding those disadvantaged groups are focused and the arrangements for public and private sector are considered in details. Also, some evaluations and problems are examined
