Özet
Kadına yönelik şiddet, aile içi şiddet dahil, cinsiyete dayalı en önemli insan hakları ihlallerinden birisi olmasına rağmen BM sistemi içerisinde spesifik olarak kadına yönelik şiddet ile ilgili herhangi bir anlaşma bulunmamaktadır. 1 Ağustos 2014 tarihinde yürürlüğe giren İstanbul Sözleşmesi uluslararası insan hakları hukuku alanında kadına yönelik şiddeti ve aile içi şiddeti doğrudan ele alan, bağlayıcı ve yaptırım gücüne sahip ilk sözleşmedir. Sözleşme kadına yönelik şiddet ile aile içi şiddeti engellemek amacıyla önleme, koruma, soruşturma ve entegre politikaların geliştirilmesi alanlarında asgari standartları düzenlemektedir. İstanbul Sözleşmesi`ni ilk onaylayan ülke olarak Türkiye kadına yönelik şiddete karşı mücadeleye ilişkin güçlü bir siyasi irade göstermiş, sözleşmeyi iç hukuku ile entegre etmeyi ve uygulamadaki diğer alanlarda sözleşmeyi uygulamayi taahhüt etmiştir. Bununla birlikte, yasal sistemdeki pozitif gelişmelere rağmen sonuçlar arzulanan aşamada değildir, zira kadına yönelik aile şiddet devam etmektedir. Bu çalışmanın amacı Türkiye`deki mevcut durumun değerlendirilmesi ile sorunların tespiti ve kadına yönelik aile içi şiddet alanında İstanbul Sözleşmesi`ne uyumu sağlamak amacıyla neler yapılması gerektiğini belirlemektir.
Abstract
Although violence against women,including domestic violence, is one of themost serious forms of gender-based humanrights violations, no treaty specificallyrefers to violence against women within theUN framework. The Istanbul Convention,which entered into force on 1 August2014, is the first binding and sanctions-imposing contract in international humanrights law that directly addresses the issueof violence against women and domesticviolence. It sets out minimum standards onprevention, protection, prosecution andthe development of integrated policies tocurb violence against women and domesticviolence. As the first country to ratify theIstanbul Convention, Turkey demonstratedstrong political will to combat violenceagainst women, committing itself tointegrating the Convention into nationallegislation and applying it to other areasof practice. However, despite positivedevelopments within the legal framework,results have not been as positive as desiredbecause domestic violence against womenpersists. The aims of this study are toassess the current situation and specifyproblems in Turkey, and then determinewhat measures should be implemented tocomply with the Istanbul Convention in thefield of domestic violence against women.
