Özet

Bu araştırma Osmanlı aile hayatında önemli bir yer tutan çocuk yaştakilere nikâh kıydırılmasıkonusunu içermektedir. Bu çocuklar henüz bulûğa ermemişlerdir. Aileleri tarafından nikâhkıydırılıyor fakat düğün daha sonra yapılacaktır. Çocuklar ise hiçbir şeyin farkında değiller.Çocukların aileleri neden böyle davranıyorlar? Bunun birçok sebebi var: akrabalık oluşturma,akrabalığı koruma, servetin bölünmemesi, çocuğu geleceğin belirsizliklerinden koruma, ebeveyninolmadığı zamanda çocuğa bir hami sağlama... Ancak kız veya erkek çocuklar aileleri tarafındanyapılan bu gelecek planına uymak zorunda değiller. Bunun için onların mahkemeye müracaatetmeleri gereklidir. İslam hukuku küçük yaşta nikâh kıyılan çocuğa, bulûğa erdikten sonramahkeme aracılığıyla bu nikâhı iptal ettirme hakkı sağlamaktadır.Araştırmamızda örnek olarak Trabzon ili seçilmiştir. Araştırmanın esas kaynağını da XIX. yüzyılınilk yarısına ait Şer'iye Mahkemesi kayıtları oluşturmaktadır. Bu kayıtlar bize küçük yaştaevlendirilenler hakkında önemli bilgiler vermektedir. Mahkeme tutanaklarında aileler arasındakitartışmalar da yer almaktadır, fakat yine de her şeyi bilme imkânına sahip değiliz. Çünkü Şer'iyeMahkemesinin kâtipleri kararları kısa, özet ve standart şekilde yazmaktaydılar. Dolayısıyla bizimşimdi merak ettiğimiz pek husus sicillere yansımamıştır. Yine de bu sürecin aileler ve çocuklar içinoldukça zorlu olduğunu tahmin edebiliriz. Bu hususlar araştırmamıza olabildiğince yansıtılmayaçalışılmıştır.

Abstract

This research covers the issue of marriage to babies or young children who have on important place in Ottoman family life. These children have not yet reached adolescence. Married by their families, but the wedding ceremony will be held later. They are not aware of anything. Why do families of the children do like this? There are many reasons for this: kinship creation, kinship protection, do not divide the wealth, protect the child from the uncertainties of the future, find a protector for the child when the parents are not... But boys or girls do not have to obey these planes made by their families on the future. It is necessary for the children to apply to the court for this. After puberty, Islamic laws are providing the abolition of this marriage for the girls or the boys married when the baby and the young child. It was selected Trabzon city as an example in our research. The main source of the research is the records of the Trabzon Sharia Court belonging to the first half of the nineteenth century. These records give us important information about the baby or the young child married by their families. There are discussions among the families in the records of the court, but we still do not have the opportunity to know everything. Because, Sharia Court clerks write short, summary and standard decisions. So now many things we are curious about did not reflect on this records. We can still guess that this process is difficult for families and children. These issues were tried to be reflected as much as possible this article.
