Özet
Osmanlı döneminde kadınlar kendi adlarına vakıflar kurabilmekte, mütevelliyesi olarak da vakfın işleyişini yürütebilmektedir. Çalışmada bahsi geçen Zeliha Hatun Tanzimat’tan sonra oluşturulan yeni hukuk yapısı içerisinde Edremit kazasında evladiyelik vakıf olan Hacı Mustafa Ağa Vakfı’nın mütevelliyesi olarak XIX. yüzyılın ikinci yarısında Edremit-İstanbul arasında verdiği hukuk mücadelesi ile kayıtlara geçmiştir. Mütevelliyesi olduğu vakfın, mülk ve gelirlerinin gasp edildiği iddialarını ilk başta eşi Hacı Mehmet’i vekil kılarak mahkemeye taşıyan Zeliha Hatun, ilerleyen süreçte bahsi geçen iki şehir ve resmî kurumlar arasında deyim yerindeyse mekik dokumuştur. Bu süreçte gerek Edremit’te yerel meclise ve merkezde İstanbul’da Meclis-i Vâlâ’ya sunduğu arzuhalleri aracılığı ile gerek meclis mahkemesindeki beyanları ile her fırsatta haklılığını dile getirmiş ve mücadelesini sonuna kadar sürdürmüştür. 1853-1859 yılları arasında altı yıl devam eden bu mücadelenin belgeler ışığında izlenebilmesi taşra ile merkez arasındaki sistemin işleyişi ve kadının bu sistem içerisinde durduğu noktayı göstermesi açısından önemlidir.
Abstract
In the Ottoman period, women can establish foundations in their own name, and they cancarry out the functioning of the foundation as their trustee. Zeliha Hatun mentioned in thestudy within the newly created legal structure after Tanzimat, as the trustee of the HacıMustafa Ağa Foundation, which is the foster child foundation in Edremit accident. In thesecond half of the XIX century, it was recorded with the legal struggle between Edremit andIstanbul. Zeliha Hatun, who brought the claims that the foundation of which she was atrustee, her own property and income were seized, by acting as the deputy of Hacı Mehmet,in the process that followed, she took the ropes and got a shuttle between the two mentionedcities and official institutions. In this process, she expressed her justification at everyopportunity, both through her desires to the local assembly in Edremit and to the Assembly in Istanbul, and through her statements in the court of parliament and she continued herstruggle until the end. This struggle, which continued for six years between 1853-1859, canbe followed in the light of documents is important for the functioning of the system betweenthe country and the center and for showing the point where the woman stands in this system.
