Özet

Osmanlı taşrasında yaşayan yöneten ve yönetilen sınıfına mensup kişiler yaşadıkları bölgelerde zaman zaman bazı problemlerle karşılaşmışlardır. Yönetilen sınıfına mensup olan halk karşılaştıkları problemlerin çözülmesi için genelde yaşadıkları yerdeki kaza mahkemelerine başvururlardı. Kaza mahkemelerinde verilen karara razı olmayanlar üst mahkeme olan ve aynı derece temyiz görevine sahip Divan-ı Hümayun’a başvururlardı. Yöneten sınıfına mensup kişiler için ise durum bundan biraz daha farklıdır. Osmanlı Devleti kamu hizmetini yürüten timar sahiplerinin yaşadığı problemin çözülmesi için üst dereceli mahkemede yargılama yoluna gitmiştir. Divan’a gelen şikâyetler önceleri Mühimme defterine kaydedilirken 1649’da Şikâyet, 1742’den itibaren ise Eyalet Ahkâm defterlerine kaydedilmiştir. Bu çalışmada 1742-1800 tarihleri arasında Akçaabat kazasında meydana gelen şikâyet kayıtlarından yola çıkılarak Akçaabat kazasında yaşayanların sosyal ve hukuki durumuna değinilmiştir. Buna göre Akçaabat kazasında ve çevresinde kamu hizmetini yürüten yönetici sınıfına mensup kişiler reayaya göre daha fazla problemlerle karşılaşmışlardır. Bu problemler arasında timar ve vergiye yapılan müdahaleler vardır. Timara yapılan müdahaleler genelde timar sahiplerinin birbirine yaptığı müdahale olarak görülürken vergi konusunda ise halkın müdahalesi şeklinde görülmektedir. Vergi ve timara yapılan müdahalelerde yönetilen sınıfına mensup bazı gruplar birleşerek eşkıyalık faaliyetlerinde de bulunmuşlardır. Bu durum bölgenin güvenliğinin sağlanmasında birtakım sıkıntılara sebep olurken aynı zamanda timar sahiplerinin gelirlerinin tahsil edilmesinde önemli bir engel olmuştur.

Abstract

People living in the Ottoman provinces and belonging to the ruling and ruled class occasionallyencountered some problems in the regions where they lived. People belonging to the ruled classgenerally applied to the county courts where they lived to solve the problems they encountered.Those who did not consent to the decision made in the county courts would apply to the Court,which is the upper level and has the same degree of appeal. The situation is slightly different for carrying out the public service, the Ottoman State resorted to trial at a higher court. While complaintsto the Court were initially recorded in the Muhimme book, they were begun to be recorded in theComplaint book from 1649 on, and in the State Judicial Books from 1742 on. In this study, the socialand legal situation of the people living in Akçaabat district was dealth with, based on the complaintrecords that occurred in Akçaabat between 1742-1800. Accordingly, people from the administrativeclass who carried out public services in and around the Akçaabat district faced more problems thanthe citizens. Among these problems, there are interventions against timar and tax. While theinterventions made against the timar are generally seen as the intervention of the timar owners toeach other, it is seen as the intervention of the people in the tax issue. In the interventions to tax andtimar, some groups belonging to the ruled class united and engaged in banditry activities. While thissituation caused some problems in ensuring the security of the region, it also became an importantobstacle in collecting the income of timar owners
