Özet

6 Nisan 2017 tarihinde referandum ile kabul edilen 6771 sayılı Anayasa Değişikliği Hakkında Kanun 35 yıllık Anayasa'nın 70 maddesini değiştirerek bugüne kadar yapılan değişikliklerden hem geniş kapsamı hem de hükümet sisteminde yaratacağı radikal değişimle ayrılmaktadır. Bir sonraki genel seçimlerden itibaren Türkiye parlamenter sistemi terk edecek ve başkanlık sistemine dönüşecektir. Bu büyük anayasal değişim bir dizi hukuk reformunu da zorunlu kılmaktadır. Yeni hükümet sistemine uyumlu hale getirilmesi gereken kuralların başında ise TBMM İçtüzüğü gelmektedir. Neredeyse yüz yıl önce parlamenter sistemin ihtiyaçları düşünülerek hazırlanmış ve küçük değişikliklerle 19. ve 20. yüzyılın buhranlı dönemlerini atlatan parlamento hukukumuz büyük bir değişimin arifesindedir. 1973 yılında kabul edilen İçtüzük, yürütme organının yasama sürecine katılmasına izin veren ve hatta teşvik eden kurallar barındırmaktadır. Parlamenter sistemlerde olağan olan bu etkileşim sert kuvvetler ayrılığı ilkesi üzerine inşa edilmiş olan başkanlık sistemine uygu değildir. Bu makale mevcut İçtüzük kurallarından başkanlık sistemine ve sert kuvvetler ayrılığına uygun hale getirilmesi için yapılması gerekli değişiklikleri ele almaktadır

Abstract

Bu çalışma İ.D. Bilkent Üniversitesi Ekonomi ve Sosyal Bilimler Enstitüsünde yürütülen doktora tez çalışmasından türetilmiştir.Ö Z E Tn 16th of April 2017, Act no.6771 was adopted by a referendum, amending 70 articles of the Constitution of Republic of Turkey. Act no.6771 stands out from the previous amendments to the thirty-five-year-old constitution not just by its sheer extent but also by the radical changes it made to the system of government. Following the next parliamentary elections Turkey will leave the camp of parliamentary systems and transform into a presidential system. This momentous change will force several legal reforms, one of which is an extensive overhaul of the rules of the parliament. House rules of the Grand National Assembly of Turkey that has been tailored for a parliamentary system more than a hundred years ago and has survived all the upheavals of 19th and 20th century with minor alterations is also about to change. Current rules of the parliament ratified in 1973 allows and even urges cabinet to lead the legislative process as expected in a parliamentary system where such a role is barred by the separation of powers doctrine in a presidential system. This article focuses on the powers granted to the executive branch by the rules of the parliament in legislative process and submits suggestions as to how the current rules shall be amended to accommodate a presidential system and separation of powers
