Özet
skoç Aydınlanması’nın önde gelen bir figürü olarak Adam Smith, genel itibariyle bir iktisatçı ve ahlak filozofu olarak bilinmektedir. Fakat onun ‘Hukuk İlmi Üzerine Dersleri’ yahut bir hukuk teorisyeni oluşu çok fazla bilinmez. Bu makale, onun hukuk teorisine ilişkin düşüncelerine, ağırlıklı olarak bu kitabın merceği altında bakmaktadır. Smith’in hukuk teorisi çok açık bir şekilde tarihsel ve antropolojik bir ilginin ürünüdür, kendisine ait“uygarlığın dört aşaması teorisi”ne dayanır ve ayrıca onun iktisat ve ahlak teorilerinden bağımsız değildir. Smith’e göre hukukta değişim, toplumsal ve ekonomik değişimin parçasıdır. Ve o, bu evrimsel sürecin genel gidişatınınhükümet tasarruflarıyla değil, Görünmez El vasıtasıyla oluştuğudüşüncesinde olmuştur. Smith ayrıca hukuki kurumların duyumsal yönünü de ön plana çıkarır. Abstract
Adam Smith, a leading figure of the Scottish Enlightenment, is generally known as an economist and moral philosopher. But known almost not at allfor his ‘Lectures on Jurisprudence’ or as a legal theorist. This article looks atSmith’s jurisprudential thoughts mainly through the lens of this book. Smith's jurisprudence is clearly an output of a historical and anthropologicalinterest, hinges on his “the four stages theory of civilization” and finally notindependent from his theories of economics and morality. In Smith’s view,legal change is part of social and economic change. And he believed that thegeneral course of this evolutionary progress was laid down by the InvisibleHand, not by governmental acts. Smith stressed also the sentimental aspectsof legal institutions. The concept of sympathy and the feeling of justiceconcern the process that leads to rewarding or punishing human actionsaccording to their merits or demerits. This article will examine Smith’s‘Lectures on Jurisprudence’ and his thoughts on the foundations of law inbroad strokes and by considering his theories on morality and economics.
