KAMBİYO SENETLERİNE MAHSUS HACİZ YOLU İLE TAKİPTE ÇEKE İLİŞKİN SORUNLAR

Özet

Alacağı kambiyo senedine müstenit olan alacaklı kambiyo senetlerine mahsus haciz yolu ile takip yapabilir. Senet mutlaka kambiyo senedi olmalı ve alacak kambiyo hukuku münasebetinden doğmalıdır. Kambiyo senetleri bono poliçe ve çektir. Takip alacaklının bir takip talebiyle yetkili icra dairesine başvurusu ile başlar. Takip talebini alan icra müdürü gerekli incelemeleri yaptıktan sonra borçluya bir ödeme emri gönderir. Borçlu ödeme emrine süresinde ve gereği gibi karşı koymazsa takip kesinleşir. Kambiyo senetlerine mahsus haciz yolu ile takipte görülen çeke ilişkin sorunlar ve özel durumlar çeşitlilik arz etmektedir. Çekte zamanaşımı süresinin kısa olması, çek fotokopisi ile takip yapılması, çekin takibe konmasında yetkili icra dairesi, çekin takibinde protesto evrakının takip talebine eklenmesi, çekte vade tarihi bulunmaması ve ileri tarihli çek uygulaması bunlardan bazılarıdır. Çalışmamızda bu hususlar incelenecektir.

Abstract

The creditor, whose credit based on a bill of exchange, is authorized to initiate executive proceeding peculiar to bills of exchange. Creditor should hold a bill of exchange and credit should be based on a foreign exchange action. Bills of exchange are bond, policy and check. Proceeding begins with the receiving of proceeding request form by the competent execution office. The execution officer, who receives the proceeding request form, makes the necessary examination sand consigns a commandment to debtor. If debtor does not oppose to the commandment appropriately in due time, proceeding becomes definite. There are a lot of different issues concerning check in executive proceeding peculiar to bills of exchange. Short period of limitation in check, initiation to the proceeding with the copy of check, competent execution office in the proceeding of check, attachment of the notice of protest to the proceeding request form, absence of fixed time in check and post-dated check are the main examples. These issues are going to be examined in our article.
